3. TIMING/DESCRIPTION: The Promotion begins at 12:00:00 AM Pacific Time (PT) on March 13, 2015 and ends at 11:59:59 PM PT on April 11, 2015 (“Promotion Period”). The Promotion consists of the Instant Win Game where one (1) First Prize, ten (10) Second Prizes and fifty (50) Third Prizes are available to be awarded daily, and the Sweepstakes where one (1) Grand Prize will be awarded at the end of the Promotion Period in a random drawing from among all entries received. Unclaimed Instant Win Prizes will not be awarded.
4. HOW TO PLAY THE GAME AND BE ENTERED IN THE SWEEPSTAKES: To play the Game, go to https://www.paypal.com/5million (the “website”) and watch the 60-second video that appears on the website during the Promotion Period. At the end of the video, you will be asked to log in to PayPal, or if you do not have a PayPal account, you will be asked to sign up for a PayPal account. Once you log in to PayPal or sign up for a PayPal account during the Promotion Period, you will receive a message telling you whether or not you are an instant winner (“Game Play”). If you receive a prize winning message, you are a winner of the prize indicated subject to verification of eligibility and compliance with the terms of these Official Rules. If you do not receive a prize winning message, you are not an instant winner. Winning messages will be seeded randomly by Sponsor each day throughout the Promotion Period. If you are the first person to play the Game at or after one of the randomly-seeded times, you will be a potential instant winner of the prize indicated. Limit one (1) Game Play per person/PayPal account during the Promotion Period. Subsequent Game Plays submitted by the same person/PayPal account will be void. Game Play must be completed during the Promotion Period in order to be valid. Proof of Game Play and/or winning that is generated or provided by a participant shall not be considered proof of playing and/or winning by Sponsor. Game Play must be made by 11:59:59 PM PT on April 11, 2015. Any unclaimed Instant Win Prizes will not be awarded.
Once you successfully complete a Game Play during the Promotion Period, you will be automatically entered in the Sweepstakes and be eligible for the Grand Prize random drawing. All Sweepstakes entries must be received by 11:59:59 PM PT on April 11, 2015 in order to be eligible for the Sweepstakes. Limit one (1) entry per person/PayPal account during the Promotion Period. Subsequent entries submitted by the same person/PayPal account will be void.
Game Plays made with the same or multiple PayPal accounts, under same or multiple identities or through the use of any agent or other device or artifice to play multiple times will be deemed invalid. Incomplete Game Plays not complying with these Official Rules are subject to disqualification and will be deemed void. Game Plays that have been generated by a script, macro, bot or any other automated means will be deemed void. Game Plays that are mechanically reproduced, copied, illegible, incomplete or inaccurate are void. All materials submitted in connection with the Promotion become the property of the Sponsor and will not be acknowledged or returned. If a dispute results as to the identity of a participant, it will be determined that the online Game Play was submitted by the authorized account holder of the PayPal account from which the Game Play is made. For these purposes, the authorized account holder is the natural person assigned to the PayPal account by PayPal Inc. Releasees (as defined below) are not responsible for late, lost, incomplete, illegible, damaged, inaccurate, delayed or misdirected Game Plays. Use of the website, and Sponsor’s use of information submitted by participant in connection with the Promotion, will be subject to the terms and conditions stated in these Official Rules as well as to the Sponsor’s Privacy Policy available on the Sponsor’s Web Site at https://www.paypal.com/webapps/mpp/ua/privacy-full . To the extent of any conflict between these Official Rules and the Sponsor’s Privacy Policy, these Official Rules shall govern. If a participant changes his/her telephone number, email address and/or street address after he/she participates in the Promotion, it is his/her sole responsibility to notify the Sponsor by (postal) mailing notice to the Sponsor’s address (listed below) to be received by the end of the Promotion Period.
5. SWEEPSTAKES GRAND PRIZE RANDOM DRAWING: A random drawing will be conducted by an independent judging organization on or about April 13, 2015 to award the Grand Prize from among all eligible entries received as stated above in Rule #4. Odds of winning a Grand Prize in the Grand Prize Random Drawing are dependent on the number of eligible entries received during the Promotion Period. Decisions of the judges and Sponsor will be final and binding on all matters relating to this Promotion.
6. WINNER NOTIFICATION AND VERIFICATION: Potential Instant Win Game winners will receive immediate notification online, subject to verification of eligibility and compliance with the terms of these Official Rules. Potential Grand Prize winner will be notified on or about April 13, 2015 by electronic mail, overnight or U.S. mail and will be required to execute an affidavit of eligibility and liability release and where legal, a publicity release and federal and state tax release, and return these documents, properly executed, by mail within 7 days of date of issuance of notification. Instant Win Game winners may be required to verify their mailing addresses prior to issuance of a prize. A potential winner will be disqualified and the prize may be awarded to an alternate potential winner for any of the following reasons: failure to return any or all documents, fully executed, within the specified time period; a prize or prize notification being returned as undeliverable; a potential winner not complying with any of these Official Rules; or Sponsor’s inability to contact a potential winner within a reasonable time. If any winner is eligible but still considered a minor in his/her state of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein. Allow 6-8 weeks for delivery of a prize. Limit one Instant Win Prize per person/PayPal account. A person may win both an Instant Win Prize and the Grand Prize. All claimed prizes will be awarded.
7. PRIZES: INSTANT WIN PRIZES: One (1) First Prize: $100. Approximate Retail Value (ARV): $100. Ten (10) Second Prizes: $25. ARV: $25/each. Fifty (50) Third Prizes: $10. ARV: $10/each. SWEEPSTAKES RANDOM DRAWING PRIZE: One (1) Grand Prize: $50,000. ARV: $50,000. Total ARV of all prizes: $75,500. All prizes to be awarded as a transfer to each winner’s PayPal account. Prize Winners must have or must create a United States PayPal Account in good standing (the “PayPal account”) in order to receive, access, and use the prize. If you are an existing PayPal customer, your prize will be transferred in the PayPal account associated with the email address you provided. If the email address you provided is not associated with your PayPal account, you must associate it with your PayPal account within 7 days from time of prize notification. Prize will be transferred into the winner’s PayPal account within 6-8 weeks of prize notification. A Winner must have a U.S. PayPal account in good standing at time of prize award. A prize will not be awarded to a winner with a locked, closed or restricted account.
All taxes and any other costs not specifically stated within these Official Rules are the sole responsibility of the winners. Prizes may not be transferred, substituted or redeemed for cash, except at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if advertised prize is unavailable at the time the prize is awarded. All claimed prizes will be awarded.
8. ODDS OF WINNING AN INSTANT WIN PRIZE: Odds of winning a First Prize each day: 1 in 12,000. Odds of winning a Second Prize each day: 1 in 1,200. Odds of winning a Third Prize each day: 1 in 240. Odds of winning any Instant Win Prize per day: 1 in 197. Odds based upon an estimate of 12,000 Game Plays transacted each day during the Promotion Period; actual odds of winning will depend upon the actual number of Game Plays transacted each day.
9. CONDITIONS OF PARTICIPATION: By participating, participants agree to be bound by these Official Rules including all eligibility requirements. Sponsor will collect information from the participant solely for the purpose of administering the Promotion and to notify the winners. Sponsor will not share this information with any third parties, except as necessary for the administration of the Promotion, of if participant agrees to receive future information from the Sponsor or third parties. Sponsor’s use of information submitted by participants in connection with this Promotion will be subject to the terms and conditions stated in these Official Rules as well as to the Sponsor’s Privacy Policy available at https://www.paypal.com/webapps/mpp/ua/privacy-full. All materials submitted in connection with the Promotion become the property of Sponsor and will not be returned. By accepting a prize, a winner consents to the use of his/her name, image, likeness, photograph, voice and biographical material and entry submission for advertising, publicity and promotional purposes by Sponsor, or a party designated by Sponsor, in any and all media now or hereafter known including but not limited to, any online announcements, or for sharing this information for viewing, whether TV or print, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law. In such event, Sponsor may void any Game Plays/entries they suspect are at issue and award the prize from among all non-suspect, eligible Game Plays/entries received up to the date of cancellation. Any attempt by an individual to access any website associated with the Promotion via a bot script or other brute force attack or any other unauthorized means will result in that individual’s IP address and all Game Plays/entries from that IP address becoming ineligible. Use of automated entry devices or programs is prohibited.
11. NUMBER OF PRIZES: No more than the listed number of prizes will be awarded. In the event of a production, technical or human error, or for any other reason, the number of winning Game Plays distributed or received for any prize level exceeds the number of prizes listed in these Official Rules for that level, Sponsor reserves the right to conduct a random drawing from among all non-suspect, eligible prize claims received to award the listed number of prizes for that level.
12. DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California), or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
