ELIGIBILITY:  The Race with Ricky Sweepstakes (“Sweepstakes”) begins on January 15, 2017 at 12:01:00 p.m. Eastern Time (“EST”) and ends on August 18, 2017 at 11:59:59 a.m. EST (“Promotion Period”).  The Sweepstakes is open to legal residents of the United States, including D.C., who are 13 years of age or older at time of entry.  Void where prohibited.  Employees of Sunny Delight Beverages Company (“Sponsor”), and its parent companies, subsidiaries, affiliates, advertising agencies, public relations agencies, prize suppliers, including any vendors providing services in connection with this Sweepstakes, including Brand Connections, LLC, Roush Fenway Racing, LLC and Ricky Stenhouse, Jr. (collectively, the “Sponsor Affiliates”), and employees, agents, directors, officers (including members of their immediate family – i.e., spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren – or same household) of Sponsor or any Sponsor Affiliates are not eligible to participate.

TO ENTER:  During the Promotion Period, eligible entrants may enter the Sweepstakes by visiting www.SunnyD.com during the Promotion Period and filling out the sweepstakes entry form located on the site, completely and accurately. By visiting SunnyD.com you agree to be bound by Sponsor’s Terms of Use, located at http://www.sunnyd.com/terms-of-use/ and Privacy Policy, located at http://www.sunnyd.com/privacy-policy/, which are incorporated herein by reference.

Limit one (1) entry per person per day during the Promotion Period (including, as applicable, household, email and/or phone number). No mechanically reproduced entries of any kind permitted. Illegible and incomplete entries are void.  Entries by means of software-generated or other automated processes will be disregarded. The use of multiple identities and/or accounts is prohibited, and any attempt to obtain more than the stated number of prizes will void that participant’s entries and may result in participant’s disqualification. Incomplete, forged, altered, automated, mechanically reproduced, lost, late, misdirected, garbled or illegible entries will be disqualified. Sponsor will not be responsible for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender, Sponsor, or Sponsor’s Sweepstakes application service provider. In the event of a dispute, Sponsor will determine who submitted the disputed entry in its sole discretion.

All entries become property of Sponsor and none will be returned. Any questions shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons who submit false or misleading entry information or who Sponsor determines to be tampering with or abusing any aspect of the Sweepstakes.

PRIZE DRAWING: There are two categories of Prizes to be awarded in this Sweepstakes, Weekly Prizes and a Grand Prize, each of which will be selected in a random drawing from all eligible entries at large. The “Weekly Prize Winners” will be selected and notified every Monday starting on January 23^rd, 2017 and ending on August 18, 2017. The “Grand Prize Winner” will be selected and notified on August 21, 2017. There is a limit of two (2) Prizes per person in this Sweepstakes, any one person may only win one (1) Weekly Prize and one (1) Grand Prize. The odds of winning either Prize will depend upon the number of eligible entries received.

PRIZES:  The following prizes, in the quantities noted and having the listed approximate retail value (“ARV”), will be awarded.  The total ARV of all prizes to be awarded in this Sweepstakes is thirty-six thousand dollars ($36,000).

Prizes are awarded “AS IS.”  Neither Sponsor nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Sweepstakes or any prize.  Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor’s sole discretion.  Prizes consist only of the items listed, are non-transferable, with no cash redemption or substitution except at Sponsor’s sole discretion.  Federal, state, or local taxes on prizes, if any, and any other costs, fees or expenses not listed above are the sole responsibility of each winner.

Without limiting the foregoing and for purposes of clarity, neither Sponsor nor Sponsor Affiliates will issue any replacement prize or any other remuneration where (1) the ticketed event is postponed, cancelled, or otherwise incomplete for any reason or (2) the ticket(s) you receive does not allow you (or any other person) to enter the ticketed event for any reason.

All travel arrangements must be made through Sponsor’s agent. Any other costs and expenses associated with prize acceptance and use not specifically provided herein (such as security fees, gratuities, luggage fees, meals and transportation, and incidental charges) are the responsibility of the winner. Ground transportation may be provided in lieu of air transportation if winning entrant resides within a 100-mile radius of destination, and no compensation or substitution will be provided for difference in value. Each Player must possess and show valid travel documents, prior to departure (e.g. passport, visa, valid driver’s license, or other acceptable government-issued identification), and must sign a Release of Liability/Publicity and any other documents provided to him or her prior to ticketing. Once airline tickets have been ticketed, no changes will be permitted. Sponsor will determine airline, airports, flight itinerary, and hotel in its sole discretion. Travel and accommodation restrictions, conditions, and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets or travel vouchers.

NOTIFICATION: Winner(s) will be notified by available phone number or mail/email address, as determined solely by Sponsor. If a Winner is a minor in his/her state of residence, the prize may be awarded to the minor’s parent or legal guardian and the parent or legal guardian will be required to complete, sign and return the Affidavit of Eligibility and Liability and (where permitted) Publicity Release within the same time period. Weekly winners will be notified every Monday – this will start on Monday, January 23^rd, 2017 and end on the last day of the sweepstakes on August 18^th, 2017. The Grand Prize winner will be notified on or around August 18, 2017. To claim any prize, Sponsor may require winner(s) to complete, sign, and return Affidavit of Eligibility/Liability Release/Publicity Release forms, and other applicable documents, which may require a social security number, postmarked within ten (10) days of the date on the notification.  At Sponsor’s discretion, winners may be required to produce picture or some other form of proper identification to claim any prize. Sponsor reserves the right to substitute any prize with prize of equal or greater value. If a potential winner cannot be contacted, fails to timely claim the prize, is disqualified, fails to timely execute and return any required forms, or if the prize notification is returned as undeliverable, an alternate winner will be selected from other potential winners and/or by random draw from all remaining eligible entries. If by reason or printing or other error, more prizes are claimed than the number of prizes set forth in these Official Rules, a random drawing will be held to award the advertised number of prizes in the relevant category.  Under no circumstances will more than the advertised number of prizes be awarded.

Winner is solely responsible for reporting and payment of any taxes on a prize.  Winner may be required to provide his/her valid Social Security Number to Sponsor for tax purposes and/or complete an IRS W-9 form in order to claim a prize.  Winners are solely responsible for all federal, state and local taxes on prize value and, as applicable, will be issued an IRS Form 1099 based on the prize value determined by Sponsor. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.

PUBLICITY & MARKETING:  Entry into the Sweepstakes and Acceptance of any prize constitutes permission to the Sponsor to use participants’ and/or winners’ names, biographical data, voices, statements, images and likenesses for purposes of advertising and trade, in any medium, without further compensation or notice, unless prohibited by law.  Submission of contact information in connection with this Sweepstakes (whether or not required), including, without limitation, mailing address, cell phone number, phone number, and email address during entry constitutes permission for Sponsor to add entrant to Sponsor’s customer database and to contact entrant in the future for promotional and other reasons.  You may opt-out of receiving such communications as set forth in Sponsor’s Privacy Policy (located at www.sunnyd.com) or as provided within any such marketing materials (e.g., using the “Unsubscribe” feature provided in the footer of Sponsor’s emails).

NO LIABILITY & INDEMNIFICATION:  Sponsor and Sponsor Affiliates are not responsible for and entrants release each from any failures of any kind (whether caused by computer, technical, or human error) which may either limit the entrant’s ability to submit an entry, claim a prize, or otherwise participate in this Sweepstakes, or Sponsor’s ability to include all eligible entries, conduct random drawings, notify potential winners, or otherwise execute this Sweepstakes in the manner intended.  Entrants further release and agree to indemnify Sponsor and Sponsor Affiliates from any and all liability, claims or actions of any kind whatsoever arising from injuries, damages, or losses to persons or property which may be sustained in connection with this Sweepstakes including, but not limited to: (a) the receipt, ownership or use of any prize awarded; (b) any travel or prize-related activity; (c) any typographical or other error in these Official Rules or any other materials disseminated by Sponsor; (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with any equipment, systems, networks, lines, satellites, servers, computers, or providers used by an entrant or Sponsor; and (e) the authenticity, or lack thereof, of any autographs, tickets, or any other prize.

OTHER TERMS: Decisions of Sponsor on all matters related to the Sweepstakes are final.  Sponsor reserves the right to cancel or modify the Sweepstakes for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Sweepstakes, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Sweepstakes as determined by Sponsor, in its sole discretion. Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL & CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY LAW.
