1. SWEEPSTAKES PERIOD/GAMES.

The Heineken USA “What’s Your Play” Sweepstakes (“Sweepstakes”) begins at 12:00 a.m. EST on January 2, 2017, and ends at 11:59:59 p.m. EST on February 5, 2017 (the “Sweepstakes Period”). It is sponsored by Heineken USA Inc. (“Sponsor” or “HUSA”). There will be a total of twelve (12) separate game entry periods (each, a “Game”) during the Sweepstakes, and five (5) separate weekly grand prize entry periods, as set forth below:

• 1/29/17 SUNDAY – GAME 11: 8-11pm (Total: 3 hours)
• 2/5/17 SUNDAY – GAME 12: 6-10pm (Total: 4 hours)

Each Game is a separate entry period, with entry beginning and ending at the times indicated above. Only entries made during the predetermined time slots indicated above will be eligible; any entries submitted outside of the Game periods indicated above will not be valid or eligible for a Game prize in the Sweepstakes.

WEEKLY GRAND PRIZE SWEEPSTAKES SCHEDULE (all times U.S. Eastern Time Zone):

All entries submitted during each of the week’s set forth above, including all eligible Game Day Tweets tweeted during the respective weekly entry period, will automatically receive one (1) entry to win a weekly grand prize, if eligible. Each weekly grand prize drawing will consist of all eligible entries received as of 11:59:59 p.m. EST on the day prior to the date of the applicable weekly grand prize drawing. For the avoidance of doubt non-winning eligible entries will be retained for subsequent weeks’ weekly grand prize drawings. Odds of winning a weekly grand prize will be determined by the total number of eligible entries received for each weekly grand prize drawing.

1. HOW TO ENTER.

 There are three (3) different ways to enter the Sweepstakes (“Entry Methods”).

Entry Method No. 1: Enter online. To participate in the Sweepstakes, go to www.whatsyourplay2017.com on your mobile device or desktop, provide your name, address and date of birth, and follow the online instructions to enter.

Entry Method No. 2: Enter via mobile rebate. A person redeeming a mobile rebate advertised by Sponsor may participate in the Sweepstakes by selecting the checkbox permitting a direct entry in the Sweepstakes during the redemption process for the mobile rebate. Entry via this Entry method will automatically transmit the entrant’s name and address, provided as part of the mobile rebate redemption, with such transmission constituting the entrant’s entry in the Sweepstakes.

Entry Method No. 3: Enter via Twitter. To participate in the Sweepstakes, you must have an active non-private Twitter account (i.e., your tweets must be set to “public” and not “private”) and you must follow the @WhatsYourPlay Twitter handle at http://www.twitter.com/whatsyourplay. If you do not have a Twitter account, you can create one for free at www.twitter.com. During each Game, @WhatsYourPlay will tweet a new Sweepstakes-related question once every football game quarter to all followers. To enter the Sweepstakes, log onto your Twitter account during a Game and answer one of the Sweepstakes-related questions that @WhatsYourPlay tweets during that Game. Your response tweet must include your answer to the question, must tag @WhatsYourPlay, must include #whatsyourplaysweeps in tag and comply with these Official Rules (including the Submission Guidelines below), and must be made within the predetermined Game schedule for the Game during which @WhatsYourPlay tweets the Sweepstakes-related question.

ENTRIES SUBMITTED USING ENTRY METHOD NO. 1 OR NO. 2 ARE NOT ELIGIBLE TO WIN GAME PRIZES, BUT WILL BE AUTOMATICALLY ENTERED TO WIN A WEEKLY GRAND PRIZE, IF ELIGIBLE.

All entry information, response tweets, shall be referred to herein as the “Entry” or the “Submission.” Any Submission made outside of the applicable Game time slot or weekly time period which otherwise does not comply with these Official Rules will not be eligible for this Sweepstakes. The Twitter platform will be the official time clock for the Sweepstakes. There will be a total of twelve (12) Games during the Sweepstakes Period. A response tweet to any of the questions tweeted during the Game will be considered an entry for that Game, however only one (1) entry per person/Twitter account is allowed per Game. Any additional tweets made during the same Game will not be considered a Submission and will not be eligible to win a Game prize.

Important Notice: If you post or receive tweets/updates or enter from your wireless device using entry method 1 or 2 on a wireless service provider’s network (as opposed to a Wi-Fi network), your carrier’s standard text message and/or data rate charges may apply. Please consult your wireless-service provider plan regarding pricing.

All Entries become the sole and exclusive property of Heineken USA Inc. (“Sponsor”) and will not be acknowledged or returned. Automated means of entry and entries by any means which subvert the entry process are prohibited and all such entries will be void. Any attempt by any entrant to obtain entries by using multiple/different Twitter accounts, identities, registrations, or logins, or through any other methods, may void all of that entrant’s entries and that entrant may be disqualified. If your Twitter account is set to “protected mode” your updates/response tweets will not be visible in Sponsor’s @Reply inbox and will be considered to not be received by Sponsor, resulting in your failure to enter the Sweepstakes. All terms and conditions of Twitter.com apply. Sponsor is not responsible for late, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind, whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor.

Submission Guidelines: Submissions must be in English and may not exceed 140 characters. In addition, Submission shall not contain references or material that: (a) implies or condones irresponsible or inappropriate behavior or consumption; (b) implies that the consumption of alcoholic beverages is acceptable before or while operating machinery, driving a vehicle or undertaking any other activity that requires a high degree of alertness or physical coordination; (c) references, directly or indirectly, consumption of alcoholic beverages by individuals under the legal age to consume alcoholic beverages; (d) degrades or demeans the human form, image or status of women, men or the members of any group based on race, religion, ethnic background, sexual orientation or any other minority status, (e) may reasonably be considered as obscene, provocative, lewd or otherwise objectionable, or that would reflect poorly on Heineken USA or any of its brands; (f) disparages any person, brand or competitor; or (g) violates the standards set forth in The Beer Institute’s Advertising and Marketing Code. By entering the Sweepstakes, each entrant agrees that his/her Submission conforms to these Submission Guidelines and that Sponsor, in its sole discretion, may remove any Submission and disqualify an entrant from the Sweepstakes if sponsor believes, in its sole and absolute discretion, that the entrant’s Submission fails to conform to these Guidelines or is otherwise inappropriate or in violation of the spirit of the Sweepstakes in any way.

1. ELIGIBILITY.

Open to legal residents of the forty-eight (48) contiguous United States and the District of Columbia who are twenty-one (21) years of age or older at time of entry. Eligibility for a Game prize is limited to entrants who have or create a Twitter account through Twitter at https://twitter.com. Void in Alaska, outside the United States, and where prohibited or restricted by law. The following individuals and members of their families (parents, grandparents, children, siblings, spouses) and immediate households (whether related or not) are not eligible for participation in the Sweepstakes: employees, officers and directors of Sponsor and its parent, subsidiary and affiliated companies, alcoholic beverage suppliers, wholesalers, distributors and importers, alcoholic beverage retailers and Sponsor’s advertising and promotion agencies. All federal, state and local regulations apply.

In order to enter the Sweepstakes or receive a prize, you must fully comply with these Official Rules, and by entering you agree to be bound by these Official Rules, and the decisions of Sponsor, whose decisions shall be binding and final in all respects, and you certify that you are eligible to enter. Any entrant may be disqualified in Sponsor’s sole discretion if he/she fails to comply with any of the terms of these Official Rules.

In order to enter the Sweepstakes or receive a prize using Entry Method No. 3, you must also fully comply with, all of Twitter’s terms at https://twitter.com/tos and privacy terms at https://twitter.com/privacy (collectively, “Twitter Terms”), and by entering you agree to be bound by these Official Rules and Twitter Terms.

1. PRIZES.

One hundred fifty (150) prizes will be awarded throughout the Sweepstakes Period.

• Game 1- 12: A total of one hundred and forty-five (145) game prizes will be awarded
• Weekly Grand Prizes: Five (5) grand prizes will be awarded

Winners will receive a prize package according to the below charts. None of the prize providers listed below other than Sponsor and its affiliated companies is in any way a sponsor of the Sweepstakes, and inclusion of a brand name for a prize below is not meant to indicate that those brands are in any affiliated with Sponsor or the Sweepstakes. Prize package contents and values are subject to change. Approximate Retail Value varies per prize. The total combined estimated ARV of all one hundred fifty (150) prizes is $45,461.82.

No part of any prize includes any alcoholic beverages. Prizes are awarded “as is” with no warranty or guarantee, either expressed or implied by Sponsor. By accepting the prize, winner acknowledges that Sponsor has neither made, nor is in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to such prize or any component thereof, including, but not limited to, its quality, mechanical condition or fitness for a particular purpose. Prizes are not transferable or redeemable for cash. No substitutions of prizes by winners are allowed, but Sponsor reserves the right to substitute a prize of equal or greater value. Prize pack may take up to 4-6 weeks to arrive upon winner verification. Delivery of a prize will require a street address (no P.O. Boxes). Once a prize has been delivered to a winner, all liability for any loss or damage, including any property damage, personal injury, or death to the prize winner or any third party shall be the sole responsibility of the prize winner and the prize winner shall indemnify and hold harmless Sponsor and its affiliates for any claims therefore.

All federal, state and local taxes, fees, and surcharges on any prize are the sole responsibility of winner of the prize. Winners of prizes with a value of $600 or more will be issued an IRS Form 1099-MISC early in the year following the year in which prize was awarded for filing with his/her federal and state tax returns. Sponsor complies with all tax reporting requirements. The amount of any tax liability will vary depending on winner’s tax bracket.

1. ODDS OF WINNING.

Odds of winning will depend on the number of eligible entries received for each Game and Weekly Grand Prize period.

1. WINNER SELECTION, NOTIFICATION AND VERIFICATION; PUBLICITY RIGHTS.

Game prize winners will be determined via random drawing from among all eligible Entries submitted using Entry Method No. 3. Each potential winner will first be notified the Monday following the applicable Game via private message from the @WhatsYourPlay account. To claim a prize, each potential winner will be required to respond to the @WhatsYourPlay account within twenty-four (24) hours after transmission of the aforementioned message and provide his/her full name and email address. Subsequently, each potential winner will receive additional prize claim instructions by email and will be required to complete an affidavit of eligibility, liability and (where legal) publicity release, which must be returned within the time period specified in the notification letter or, at Sponsor’s sole discretion, a potential winner may be disqualified, in which case an alternate potential winner will be selected.

Limit one (1) Game prize per person, household, street address and/or Twitter account per week.

Weekly grand prize winners will be determined via random drawing from among all eligible Entries submitted during a weekly grand prize period, through any Entry Method. Potential winners will be contacted via e-mail if they entered using Entry Method No. 1 or No. 2, or will be contacted via private message from the @WhatsYourPlay account if they entered using Entry Method No. 3, in which case each potential winner will be required to respond within twenty-four (24) hours after transmission of the aforementioned message and provide his/her full name, date of birth and email address. Subsequently, each potential winner will receive additional prize claim instructions by email and will be required to complete an affidavit of eligibility, liability and (where legal) publicity release which must be returned within the time period specified in the notification letter or, at Sponsor’s sole discretion, a potential winner may be disqualified, in which case an alternate potential winner will be selected. Entrants fully and unconditionally agree to be bound by these Official Rules and the decisions of the Sponsor, which will be final and binding in all matters relating to the Sweepstakes. Weekly drawings will occur on the following dates:

• Weekly Winner 1: Selected on 1/9/17
• Weekly Winner 2: Selected on 1/16/17
• Weekly Winner 3: Selected on 1/23/17
• Weekly Winner 4: Selected on 1/30/17
• Weekly Winner 5: Selected on 2/6/17

Limit one (1) Weekly Grand Sweepstakes prize per person, household, street address, e-mail and/or Twitter account per sweepstakes period.

At the sole discretion of the Sponsor, disqualification, prize forfeiture and the selection of an alternate winner may result from any of the following: (a) a potential winner’s failure to respond to initial notification via Twitter through @WhatsYourPlay or within the time period stated in the transmission; (b) the failure of notification due to deactivation of the potential winner’s Twitter account prior to receipt of notification; (c) a potential winner’s failure to become a follower of @WhatsYourPlay on Twitter; (d) a potential winner’s Twitter account being set to “protected mode” so that the potential winner’s updates/responses may not be visible in Sponsor’s @Reply inbox; (e) potential winner’s failure to provide Sponsor with satisfactory contact information such as phone number or email address for further communication; (f) potential winner’s failure to complete and return required documents by the date specified in winner’s notification email; and (g) any other non-compliance with these Official Rules.

Potential winners may each be required to sign and return, where legal, an Affidavit/Declaration of Eligibility and Liability/Publicity Release within three (3) days of notification that they are a potential winner. If required by Sponsor, no potential winner will be an official winner until his/her Affidavit/Declaration of Eligibility, Liability and Publicity Release has been returned and eligibility has been formally verified by Sponsor. If any potential winner fails to comply with these Official Rules and/or to submit the required documentation within the designated time period, he/she will automatically be disqualified and the prize may be awarded to an alternate winner. Participation in the Sweepstakes and acceptance of prize constitutes each winner’s permission for Sponsor or its agents to photograph, film and record winner, and to use his/her name, address (city and state), likeness, photograph, voice, biographical information and/or any statements made by him/her regarding the Sweepstakes or Sponsor for purposes of trade, publicity or Sweepstakes without notice or additional compensation, except where prohibited by law.

1. LICENSE AND RELEASE.

By posting a Submission, entrant grants to Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such Submission, in whole or in part, on a worldwide basis, in perpetuity, and to incorporate it into other works, in any form, media or technology now known or later developed, for any purpose whatsoever, including for promotional or marketing purposes. By participating and/or accepting a prize, entrants and/or winners agree to release and hold harmless Sponsor, its advertising and promotion agencies, Twitter and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, (“Released Parties”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death that may occur in connection with, preparation for, travel to, or participation in the Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity, including but not limited to any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor is not responsible if any part of a Sweepstakes prize cannot be awarded due to acts of God, acts of war, natural disasters, weather or acts of terrorism. Entrants who do not comply with these Official Rules, or attempt to interfere with this Sweepstakes in any way shall be disqualified. There is no purchase required to participate. A purchase does not increase odds of winning.

1. ADDITIONAL TERMS.

Multiple entrants are not permitted to share the same Twitter account or e-mail address. In case of a dispute as to the identity of any Twitter entrant, Entries made by Twitter will be deemed made by the authorized account holder at the time of Entry submission. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the Twitter handle associated with the winning Entry. If for any reason the Sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, automated Entries, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. In the event the Sweepstakes is terminated prematurely, all eligible Entries received prior to the Sweepstakes being compromised will be included in the prize drawing. Sponsor assumes no responsibility for any error, omission, interruption, or other communications malfunctions, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or Entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the Sweepstakes. Sponsor and its agents are not responsible for printing, distribution or production errors and may rescind, cancel, suspend, modify or revoke this Sweepstakes based upon any such error without liability in their sole discretion. If by a reason of a printing, computer or other error, more prizes are awarded in a prize category than the number set forth in these Official Rules, all persons purportedly making valid claims will be included in a random drawing to award the advertised number of prizes available. In no case will more than the advertised number of prizes be awarded. Anti-fraud detection devices may be used for verification purposes.

Caution: Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANT’S ACCESS TO AND USE OF THE WEBSITES AND/OR THE SWEEPSTAKES, OR ENTRANT’S DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES.

1. DISPUTES AND GOVERNING LAW.

The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in New York City, New York.

THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS AND RULES. For any matters that are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to New York City, New York. The parties agree not to raise the defense of forum non conveniens.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.

1. USE OF DATA.

Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy at http://www.heineken.com/us/disclaimer.aspx. By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.

1. LIST OF WINNERS.

To receive a list of winners, mail a self-addressed, stamped envelope with sufficient postage to: Avid Marketing Group, P.O. Box 1008, Rocky Hill, CT 06067-1008 Attention: HEINEKEN USA What’s Your Play 2017 Sweepstakes – HEI26960. All requests for a list of winners must be postmarked by 3/5/17 and received by 3/19/17.
