Haribo Gold-Bears New Flavor Vote Sweepstakes

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

  1. ELIGIBILITY

    The Haribo Gold-Bears New Flavor Vote Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States (and the District of Columbia) who are eighteen (18) years of age or older on December 17, 2016. Proof of residency and age may be required. Employees of HARIBO of America, Inc., The Reward Company, Inc. and their respective subsidiaries, divisions, affiliates, and advertising or promotional agencies or individuals involved with the design, production, execution or distribution of the Sweepstakes and the immediate family and household members of such individuals, are not eligible to enter or win. “Immediate family members” shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three months a year, whether related or not. In order to enter the Sweepstakes or receive a prize, you must fully comply with the Official Rules and, by entering, you represent and warrant that you agree to be bound by these Official Rules and the decisions of the Sponsor, whose decisions shall be binding and final in all respects relating to this Sweepstakes.

  2. SPONSOR AND ADMINISTRATOR

  3. TIMING

    The Sweepstakes begins at 12:00 AM Eastern Time (“ET”) on December 17, 2016 and ends at 11:59 PM PT on June 30, 2017 (the “Entry Period”). The Sweepstakes consists of three separate elements: (1) the daily sweepstakes portion (“Daily Prize Pool”); (2) the month sweepstakes portion (“Monthly Prize Pool”); and (3) the grand prize sweepstakes portion (“Grand Prize Pool”)

    Each Daily Prize Pool begins at 12:00:00 AM (midnight) ET and ends at 11:59:59 PM ET the same day, each day throughout the Entry Period (each, a “Daily Prize Period”). Non-winning entries from any Daily Prize Period will not be carried over to subsequent Daily Prize Pools. Sponsor reserves the right in its sole discretion to award less than the stated number of Daily Prizes in the event there are not a sufficient number of eligible Daily Prize Pool entries received in any Daily Prize Pool, or to award more than the stated number of Daily Prizes in subsequent drawing to make up.

    The start and end for each Monthly Prize Pool is outlined in the chart below (each a “Monthly Prize Period”, collectively, “Monthly Prize Periods”). Non-winning entries from any Monthly Prize Period will not be carried over to subsequent Monthly Prize Pools. Sponsor reserves the right in its sole discretion to award less than the stated number of Monthly Prizes in the event there are not a sufficient number of eligible Monthly Prize Pool entries received in any Monthly Prize Pool, or to award more than the stated number of Monthly Prizes in subsequent drawing to make up. There will be a total of seven (7) Monthly Prize Periods during the Entry Period. The Monthly Prize Periods are as follow:

    Administrator’s computer is the official time-keeping device for the Sweepstakes. The Sweepstakes is governed by these Official Rules and is subject to all applicable federal, state and local laws.

  4. HOW TO ENTER

    There are two ways to enter:

    • Enter Online. During the Entry Period go to voteharibo.com and provide your first name, last name, email address, phone number, mailing address, and date of birth, and vote for a flavor.

    • Enter by Mailing In. During the Entry Period send your first name, last name, email address, phone number, mailing address, date of birth, and your vote for cherry, apple or watermelon flavor in an envelope addressed to Haribo Gold-Bears New Flavor Vote Promotion, P.O. Box 1272, Northbrook, IL 60065-0674. Mail in entries must be postmarked during the Entry Period and received by July 7, 2017.

    Limit of one entry per person per day regardless of method of entry. Multiple entrants are not permitted to share the same email account. Use of any automated system to enter is prohibited and will result in disqualification. Sponsor or Administrator is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Sweepstakes entries all of which will be ineligible to win a prize. In the event of a dispute as to any entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder to be awarded the prize.

  5. WINNER DETERMINATION

    There will be a total of One Thousand Nine Hundred and Sixty (1,960) daily winners (ten (10) per Daily Prize Pool), seventy (70) monthly winners (ten (10) per Monthly Prize Pool), and one (1) grand prize winner in this Sweepstakes. Daily Prize winners, Monthly Prize winners and the Grand Prize winner will be randomly selected from each applicable Prize Pool by Administrator from among all eligible Entries received in each applicable Prize Pool. Odds of winning depend on the number of eligible entries received for each Daily, Monthly and Grand Prize Pool.

    Limit one (1) Daily Prize per person during the entire Entry Period; any Daily Prize winner is still eligible to win a Monthly Prize or the Grand Prize.     The Daily Prize Pool drawings will occur on or about the next business day following each Daily Prize Period. The Monthly Prize Pool drawings will occur on or about the first business day following the end of each Monthly Prize Period; except for the last Monthly Prize Pool for which the drawing will occur on or about July 10, 2017. The Grand Prize Pool drawing will occur on or about July 10, 2017. Mail in entries that are postmarked during the Entry Period and received on or before July 7, 2017 will be included in the applicable Daily Prize Pool or Monthly Prize Pool when received, and in the Grand Prize Pool. Daily winners, monthly winners and the grand prize winner may be separately or collectively referred to as “Winner(s)”.

    Potential Daily Prize Winners will be contacted via their email as provided on the entry form within one day of the applicable drawing. Potential Monthly Prize Winners will be contacted via their email as provided on the entry form within two days of the applicable drawing. Potential Grand Prize Winner will be contacted via the email or phone as provided on the entry form within two days of the drawing. Each potential Winner may be awarded a Prize (subject to timely response to notification, verification of eligibility and compliance with the terms of these Official Rules.)

    Failure of a potential Daily Prize or Monthly Prize Winner to respond to the email within fifteen (15) days of notification (potential Daily Prize winner must enter the reward code received in the notification email on the Sweepstakes site to choose a prize; potential Monthly Prize winner must reply by email with choice of theater chain for prize and mailing address), or return of message notification as undeliverable after two (2) attempts, will result in disqualification and an alternate potential Winner may be selected. Failure of a potential Grand Prize Winner to respond to the email and return a signed and notarized Affidavit of Eligibility and Release (the “Affidavit”) within seven (7) days of initial notification, may result in disqualification and an alternate potential Grand Prize winner may be selected.

  6. THE POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY ADMINISTRATOR AND SPONSOR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES.

  7. VERIFICATION OF POTENTIAL WINNERS

    Potential winners may be required to complete and return an Affidavit by the date specified, or an alternate potential winner may be selected. In the event: (a) a potential winner cannot be reached for whatever reason after a reasonable effort has been exerted or the potential winner notification or Affidavit is returned as undeliverable; (b) a potential winner declines or cannot accept, receive or use the prize for any reason; (c) of noncompliance with the above or within any of the aforesaid time periods; (d) a potential winner is found to be ineligible to enter the Sweepstakes or receive the prize; (e) a potential winner cannot or does not comply with the Official Rules; or (f) a potential winner fails to fulfill the Affidavit-related obligations, the potential winner shall be disqualified from the Sweepstakes and an alternate potential winner may be selected from among the other eligible entries received in accordance with the winner determination mechanism outlined above.

  8. PRIZES

    • One (1) grand prize will be awarded (“Grand Prize”). Grand Prize winner (the “Grand Prize Winner”) will receive a trip for four (4) to Orlando, Florida consisting of the following: (i) round trip coach class airfare for winner and three (3) guests as travel companions to Orlando, Florida from a major airport near Grand Prize Winner’s residence selected by Sponsor; (ii) five (5) days / four (4) nights standard (quadruple occupancy) hotel accommodations in Orlando, Florida (three star hotel) selected by Sponsor; (iii) an American Express Gift Card (value of the Gift Card will be computed so the total value of the Grand Prize equates $10,115); and (v) a one year’s supply of HARIBO product which shall be a single delivery of 120 bags of Haribo gummies 4-5 ounce each. Grand Prize Winner must book travel and provide signed travel companion releases within three weeks of being confirmed as the Grand Prize Winner. Grand Prize Winner must complete travel within six months of being confirmed as the Grand Prize Winner. Dates subject to availability and blackouts.

      Approximate Retail Value (“ARV”) of the Grand Prize: $10,115. Actual value of the Grand Prize may vary based on airfare fluctuations, airport selection and distance between departure and destination. Grand Prize Winner will not receive the difference between actual value and ARV. Sponsor will determine airline, and flight itinerary in its sole discretion. If Grand Prize Winner lives within 150 miles of Orlando, Florida ground transportation might be provided in Sponsor’s discretion. No refund or compensation will be made by Sponsor in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsor’s airline carrier, as detailed in the passenger ticket contracts. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of the Grand Prize Winner. Travel package does not include transportation to or from the location of air travel departure, gratuities, bar, and beverage charges or items of a personal nature. Travel restrictions, conditions and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Sponsor reserves the right to substitute the listed prize for one of equal or greater value for any reason.

      If a Grand Prize Winner’s travel companion is under the legal age of majority in his/her jurisdiction of residence, the Grand Prize Winner must be the travel companion’s parent/legal guardian. Travel companions must travel on same itinerary and at the same time as the Grand Prize Winner. Each travel companion must execute and return a Release of Liability (a Release”) prior to issuance of travel documents within three weeks of winner being confirmed as the Grand Prize Winner. If a travel companion is a minor, a parent or legal guardian must execute and return the Release. Grand Prize Winner and travel companions are solely responsible for obtaining valid documents necessary for travel. Grand Prize Winner and travel companions are solely responsible for their own conduct while accepting the prize and agree to comply with all applicable laws and regulations, and exhibit appropriate behavior, pertaining to use and enjoyment of the prize.

    • Seventy (70) monthly prizes will be awarded (“Monthly Prize”). Each Monthly Prize winner (the “Monthly Prize Winner”) will receive four (4) movie tickets. Movie tickets will be mailed once claimed by winner (through timely response to notification as provided in Section 5) to the winner’s provided address by certified mail. Movie tickets are valid 7 days a week, any date and any time except they are not good for midnight showings, 3D or IMAX movies. Additional restrictions may apply depending on the theater chosen. Monthly Prize Terms & Conditions for theater chains can be found at voteharibo.com. Retail value of movie tickets depends on where the tickets are redeemed. ARV of each Monthly Prize: $50.

    • One Thousand Nine Hundred and Sixty (1,960) daily prizes will be awarded (“Daily Prize”). Each Daily Prize winner will receive one (1) entry to a family Fun Pass venue (see venues at voteharibo.com) or digital reward (see digital reward at voteharibo.com). Winner will be able to choose Fun Pass Venue among options available at voteharibo.com. A Fun Pass is valid for 3 months, so be sure to check the blackout dates for the venue during that time period. Daily Fun Pass Prize is only valid for one (1) redemption per customer booking group, with the term “booking group” defined as one or more people accompanying the voucher holder. Reward is not redeemable for booked parties or family tickets, with the term “booked parties” defined as existing parties/events/engagements previously booked and “family tickets” defined as an admission allowing more than one person into the venue. Fun Pass prize voucher cannot be used in conjunction with any other promotional offer. The Fun Pass venues could have different values. Check the venue’s website or call them for more information. As an alternative to the Fun Pass, Daily Prize winners may select a digital reward option, one (1) $25 gift certificate from restaurant.com (no expiration date) instead of a Fun Pass. ARV of each Daily Prize: $15.

    For all prizes: Total ARV all prizes $43,015. Subject to all federal, state and local laws. Winner must have internet access to redeem some prizes. Winner is responsible for all taxes and fees associated with prize receipt and/or use. All federal, state, and local tax liabilities, as well as any other costs and expenses not specified herein as being awarded, are the sole responsibility of the Winner. Winner may be required to complete and return an IRS W-9 form (i.e. Request for Taxpayer Identification Number and Certification). No substitutions and no cash in lieu of stated prizes.

  9. PUBLICITY RELEASE

    Except where prohibited or restricted by law, winner’s acceptance of prize constitutes the winner’s agreement and consent for Sponsor and any of its designees to use and/or publish winner’s full name, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), actions and/or statements made by winner regarding the Sweepstakes or Sponsor (collectively, “Likeness”), worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval.

  10. GENERAL CONDITIONS

    Sponsor, Administrator and their parents, subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, “Sponsor Parties”) shall not have any obligation or responsibility, including any responsibility to award any prize to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Official Rules; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) entrants who have committed fraud or deception in entering or participating in the Sweepstakes or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor’s or Administrator’s reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this Sweepstakes or any promotion or prize related activities or use of the winner’s Likeness. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Sweepstakes, or with any Website promoting the Sweepstakes; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Sweepstakes multiple times through the use of multiple email addresses, or the use of any robotic or automated devices to submit entries. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Sweepstakes, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Sweepstakes, including the entire Sweepstakes, and/or modify the Sweepstakes and/or award the prize from all eligible entries received as of the termination date.

  11. RELEASE OF LIABILITY; DISCLAIMER OF WARRANTY; FORUM SELECTION CLAUSE

    By participating in the Sweepstakes, entrants and winners agree to release and hold harmless Sponsor Parties from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation, property damage, personal injury (including emotional distress), and/or death, which may occur in connection with preparation for, or participation in, the Sweepstakes, or possession, acceptance and/or use or misuse of the prize or participation in any Sweepstakes-related or prize-related activity and for any claims or causes of action based on use of my Likeness, publicity rights, defamation or invasion of privacy and merchandise delivery. The Sponsor Parties assume no responsibility for any injury or damage to entrants or to any other person’s computer or other device, regardless of how caused, relating to or resulting from entering or downloading materials or software in connection with this Sweepstakes. Entrants and winner acknowledge that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representations or guarantees, express or implied, in fact or in law, relative to any prize or any component thereof, including, but not limited to, express warranties provided by the supplier of the prize (or any component thereof) or their affiliates. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois. In addition, any dispute relating to the Sweepstakes (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in Cook County, State of Illinois. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non-convenience or lack of personal jurisdiction that they may have.

    Except as otherwise provided in these Official Rules, information collected from entrants is subject to the Haribo Privacy Policy which is available at www.voteharibo.com.

  13. WINNERS LIST AND OFFICIAL RULES

    For a copy of the Winners List or these Official Rules, send an email with the subject line of “Winners List [or Official Rules] – Haribo Gold-Bears New Flavor Vote Sweepstakes” to voteharibo@rewardrequest.com. Requests for the Winners List or Official Rules must be received by September 1, 2017. Official Rules are posted on voteharibo.com during the Sweepstakes, and the Winners List will be posted on voteharibo.com on or about July 25, 2017.
