GET OUT AND GRILL SWEEPSTAKES OFFICIAL RULES
NO PURCHASE OF ALCOHOL OR PURCHASE OF ANY KIND NECESSARY TO ENTER OR WIN.  A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.  ALCOHOLIC BEVERAGES ARE NOT INCLUDED AS A PART OF THE PRIZE PACKAGE. MUST BE 21 OR OLDER TO ENTER.

1. SPONSOR/ADMINISTRATOR: The Get Out and Grill Sweepstakes (the “Sweepstakes”) is sponsored by The Wine Group LLC dba: flipflop Wines, 4596 Tesla Road Livermore, CA 94550 (the “Sponsor”). The Sweepstakes is administered by Don Jagoda Associates, Inc., 100 Marcus Drive, Melville, NY 11747 (the “Administrator”).

2. ELIGIBILITY: Sweepstakes participation is open only to legal residents of the 50 United States and the District of Columbia who are 21 years of age or older at the time of entry.  Void where prohibited or restricted by law.  All federal, state and local laws and regulations apply. The following individuals are not eligible to participate in the Sweepstakes: employees, contractors, directors and officers of Sponsor, Weber-Stephen Products LLC, and each of its respective parent, subsidiaries and affiliated companies, distributors, wholesalers, retailers, other alcoholic beverage suppliers, and any agencies involved in the administration, development and fulfillment of the Sweepstakes including, but not limited to, Administrator, web design, advertising, marketing, public relations, and prize fulfillment companies, and the immediate family members (spouse, parent, child, sibling and spouse or “step” of each) and those living in the same households of each such individual.

3. TO PLAY THE GAME/ENTER THE SWEEPSTAKES:  The Sweepstakes begins 10:00 AM Eastern Time (“ET”) on April 1, 2017 and ends 11:59 PM ET on May 31, 2017 (the “Sweepstakes Period”).  The Sweepstakes Period consists of sixty-one daily play periods (each, a “Daily Play Period”). Each Daily Play Period begins at 12:00 a.m. ET and ends at 11:59 p.m. ET each day, with the exception of the first day of the Sweepstakes which starts at 10:00 a.m. ET. During a Daily Play Period, you may access the Sweepstakes by visiting flipflopwinesgrillsweeps.com (the “Website”) and follow the instructions to play the online slot machine instant win game.  Click the spin button on the virtual slot machine (“Game Play”) to see if you have won a prize instantly and to receive one (1) entry into the Grand Prize drawing. All on-screen wins are subject to verification. All Game Plays become the property of Sponsor. Receipt of Game Plays may be acknowledged, but such acknowledgment does not constitute any representation as to Sweepstakes eligibility. More than the specified number of Game Plays/entries from any person will void all Game Plays/entries for that person. Use of computer programs and other automated means to play is prohibited. Game Plays generated by script or bot are not eligible. Limit one (1) Game Play/entry per person per Daily Play Period.  By participating in the Sweepstakes, entrants agree to be bound by these Official Rules, and the decisions of the Sponsor and Administrator, which shall be final and binding in all respects. Normal internet access and usage charges imposed by entrant’s online service may apply and are entrant’s sole responsibility. If entering via a mobile device, normal phone/data and usage charges imposed by entrant’s phone service may apply and are entrant’s sole responsibility.

4. Prizes and Approximate Retail Values (“ARV”): Sweepstakes Grand Prize (1): A Weber® Summit® Grill Center. The ARV of the Grand Prize is $4,299 incudes delivery & assembly.  Instant Win Prizes (300 total): See the chart below for the prize descriptions and ARVs for each.

The approximate odds of winning an Instant Win Prize are 1:2,290. Limit one (1) Instant Win Prize per person/email address. All prize details will be determined by Sponsor in its sole discretion. The prizes will be awarded if properly claimed. Unclaimed prizes will not be awarded. Prizes are awarded “as is” and without any warranty, except as required by law.

5. GRAND PRIZE RANDOM DRAWING AND WINNER NOTIFICATION: The potential Grand Prize winner will be chosen in a random drawing to be held on or about June 1, 2017 from among all eligible entries received during the Sweepstakes Period. The drawing will be conducted by Administrator, an organization working on behalf of Sponsor. The odds of winning the Grand Prize will depend on the total number of eligible entries received during the Sweepstakes Period. Sponsor’s/Administrator’s interpretation of these rules and decisions shall be final.  The potential Grand Prize winner will be notified via email using the email address provided during the Sweepstakes Period.  Grand Prize winner will be required to execute and return, via email, an affidavit of eligibility and liability/publicity release (where legal) (“Affidavit package”) within seven (7) days of attempted notification, or the prize may be forfeited and an alternate winner will be selected, time permitting. Instant Win Prize winners will be required to complete a registration form once they receive the winning message on the Website.  In addition to completing the registration form they will also need to upload a copy of their government issued photo ID that displays their date of birth.  Once eligibility is confirmed Instant Win prizes will be fulfilled (to the address provided at registration) approximately 8-10 weeks after the conclusion of the Sweepstakes Period. Return of any Instant Win Prize as undeliverable will result in disqualification and prize will be forfeited.

Personally identifiable information, including entry information received, will be used to verify eligibility and award the prizes. In the event of any dispute concerning the identity of any entrant of an entry, the entry will be deemed submitted by the natural person who is the authorized holder of the transmitting account.  Sponsor and its agencies are not responsible for notifications that are misdirected because of email addresses that are no longer correct, or for any other reason beyond the exclusive control of the Sponsor.

6. GENERAL RULES/VERIFICATION: By entering the Sweepstakes, you represent and warrant that you have fully complied with these Official Rules. By accepting the prize, each winner grants permission to the Sponsor and its agencies to use his/her name, photo, city, and state for purposes of advertising, promotions, and trade without further compensation, except where prohibited by law.  By entering/playing, you hereby agree, and by accepting a prize, winners discharge and hold harmless Sponsor, Weber-Stephen Products LLC, and Administrator, their parent, subsidiary and affiliated companies, advertising and promotional agencies and prize suppliers and their respective officers, directors, shareholders, owners, employees, agents, attorneys and representatives (collectively, the “Sweepstakes Entities”) from any and all injuries, loss, claims or damages arising out of your  participation in the Sweepstakes, any information included with your entry and/or your acceptance or use or misuse of the prize.  By participating in the Sweepstakes, entrants agree that the Sweepstakes Entities will have no liability whatsoever for, and that entrant shall defend and hold the Sweepstakes Entities harmless against, any liability for any claims based on publicity rights, defamation, or invasion of privacy as well as injuries, damages, or losses of any kind, whether or not foreseeable, including, without limitation, direct, indirect, incidental, consequential or punitive damages to persons or to property arising out of the prizes awarded hereunder. Without limiting the foregoing, everything regarding the Sweepstakes, including any websites used in connection therewith and the prizes awarded hereunder, are provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement, all of which are expressly disclaimed by the Sweepstakes Entities. If for any reason the Sweepstakes is not capable of running as planned, including without limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion, to cancel, terminate, modify and/or suspend the Sweepstakes and to disqualify any individual who tampers with the entry/game play process, violates these official rules, or acts in a disruptive manner.  In the event the Sweepstakes is cancelled, terminated or suspended for any reason, Sponsor, at its sole discretion, may choose to award the Instant Win Prizes claimed prior to cancellation and award the Grand Prize from among all eligible entries received prior to cancellation. Any attempt by an entrant to deliberately damage any website involved in the Sweepstakes or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and/or civil laws and should such an attempt be made, the Sponsor reserves the right to seek all available remedies, including without limitation criminal prosecution, and damages, including without limitation attorneys’ fees, from any such entrant to the fullest extent of the law.  No responsibility is assumed by Sponsor for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries/game plays; or any problems or technical malfunctions of any telephone network or lines, typographical or other errors, computer online systems, servers or providers, computer equipment, software, failure of any email sent or electronic entry to be received on account of technical problems or traffic congestion on the internet or on any website or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to, or resulting from, participation in or downloading any materials from this Sweepstakes.  Sponsor is not responsible for any typographical or other error in the printing of the Sweepstakes materials, administration of the Sweepstakes, or in the announcement of the prizes.  Sponsor reserves the right, at its sole discretion, to disqualify any individual it determines to be tampering with any entry/game play mechanism, to be violating these Official Rules or to be acting in a disruptive manner. If, due to an error of any kind, more winning names are determined as instant winners, or more instant win prizes are claimed than are intended to be awarded according to Rule #4, the intended instant win prize(s) will be awarded in a random drawing from among all verified instant win prize claims received. In no event will the Sponsor be obligated to award more than the stated number of prizes. The Sponsor and its agencies assume no responsibility for any injury or damage to participants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes.

8. RULES/NAMES OF WINNERS: A copy of these Official Rules can be found at www.flipflopwinesgrillsweeps.com.  For the names of the winners of prizes valued at over $25, available for a period of at least 30 days after June 15, 2017, send a self-addressed-stamped envelope to: Get Out and Grill Sweepstakes Winners, 100 Marcus Drive (Dept. KF), Melville, NY 11747.

9. DISPUTES: To the fullest extent permitted by law, you agree that: (1) any and all disputes, claims and causes of action brought by you arising out of or connected with this Sweepstakes or prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California or an appropriate California State Court located in San Francisco, California if federal court is not a proper or available venue; (2) any and all claims, judgments and awards to you shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the respective rights and obligations of you and Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

Weber-Stephen Products LLC is not a Sponsor of this Sweepstakes.  You are providing your information to Sponsor and not to Weber-Stephen Products LLC.  All third party brand names and trademarks are the property of their respective owners.  References to any third party entity or trademark are not meant to imply, and should not be construed as,  an endorsement of this Sweepstakes, flipflop Wines, or flipflop® wine.
