Dole® Blend-Tucky Getaway Sweepstakes

THE FOLLOWING SWEEPSTAKES IS VALID ONLY IN THE 48 CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA. DO NOT ENTER THIS SWEEPSTAKES UNLESS YOU ARE ELIGIBLE, 19 YEARS OF AGE OR OLDER, AND LOCATED IN THE 48 CONTIGUOUS UNITED STATES OR THE DISTRICT OF COLUMBIA AT THE TIME OF ENTRY. THIS SWEEPSTAKES WILL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE UNITED STATES LAW.

The Dole Blend-Tucky Getaway Sweepstakes (“the Sweepstakes”) begins on January 4, 2016 at 12:00:00 pm Pacific Time (“PT”) and ends on February 26, 2016 at 11:59:59 pm PT (the “Promotion Period”). Sponsor’s computer is the official time-keeping device for the Sweepstakes.

How to Enter: Go to the Sweepstakes website (www.BlendTucky-Getaway.com) and follow the on-line entry instructions, completing the entry form with all required information including your first and last name, street address (no p.o. boxes), birthday and email address. Click on the submit button and you will receive one (1) entry into the Sweepstakes. Limit one entry per person/per email address per day. A “day” is defined as 12:00 am PT – 11:59 pm PT.

All entries become the exclusive property of Sponsor and none will be acknowledged or returned. Sponsor and its agencies are not responsible for lost, late, incomplete, invalid, unintelligible, illegible or misdirected entries, which will be disqualified. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to enter more than once per day by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any robotic, automated, programmed, or similar system or third-party entry services to participate is prohibited and will result in disqualification. In the event of a dispute as to ownership of any entry, the entry will be deemed made by the person’s name as listed on the entry form. Only one person’s name may appear on the entry form. You may enter the Sweepstakes under only one name and one email address. Entries must include all the required information or they will not be eligible. NOTE: Message and data rates apply to use of mobile device for Sweepstakes entry. You may be charged by your wireless carrier for accessing the mobile version of Sweepstakes website or otherwise participating in the Sweepstakes via mobile device. Eligibility: The Dole Blend-Tucky Getaway Sweepstakes is open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia who are at least nineteen (19) years old at the time of entry. Employees of Dole Packaged Foods, LLC (“Sponsor”), Alcone Marketing Group, Inc. (“Administrator”), and each of their respective subsidiaries, affiliates, parent companies, suppliers, distributors, advertising, promotion or any other agencies or entities involved with this Sweepstakes (collectively the “Released Parties”) as well as each of their immediate family members defined as spouses, (biological, adoptive or step-) parents, siblings, children and each of their respective spouses (regardless of where they reside) and household members of each such employee (whether related or not) are not eligible to enter or win a prize.

Drawings/Odds: Administrator is an independent judging organization whose decisions as to the administration and operation of the Sweepstakes and the selection of potential winners are final and binding in all respects. Administrator will randomly select the potential Sweepstakes winners from all eligible entries received during the Promotion Period on or around March 4, 2016. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period.

Prizes: One (1) GRAND PRIZE will be awarded consisting of a trip for two to the preeminent American thoroughbred horse race, taking place in Louisville, Kentucky. The prize includes round trip, coach-class air transportation for two (winner and one guest) from the major airport nearest the winner’s home (determined by Sponsor in its sole discretion); three (3) nights accommodations at a hotel determined by Sponsor in its sole discretion (one standard room, double occupancy); two tickets to the horse racing events on May 6 & 7; roundtrip transfers to/from the Louisville airport to the hotel and to/from the hotel to the horse racing events and for the winner $500.00 in spending money. Trip must be taken by May 5 – 8, 2016 or the prize will be forfeited in its entirety without compensation and an alternate winner will be selected (time permitting). The Approximate Retail Value (“ARV”) of the Grand Prize is $6,000.00. Actual value may vary based on point of departure, airfare fluctuations and final trip details. Any difference between the stated ARV and actual value of the prize will not be awarded in any form.

One Hundred (100) FIRST PRIZES will be awarded consisting of a NutriBullet Blender and one (1) coupon for a Free Dole® Fruit & Veggie Blend. The Approximate Retail Value (“ARV”) of the First Prize is $83.61 each.

The Approximate Retail Value off all prizes in the sweepstakes is $14,361.00. The prizes will be awarded provided they are claimed properly in accordance with these Official Rules. Prizes are non-transferable. All unspecified expenses in conjunction with acceptance and use of prize are the prize winner’s sole responsibility. Sponsor may substitute the prize (or portion thereof, as applicable) of equal or greater value if advertised prize (or portion thereof, as applicable) becomes unavailable for any reason, as determined by Sponsor in its sole discretion. There is a limit of one (1) prize per family, household or address. First Prize winners will be shipped the prize within eight weeks of the drawing date after the winner has been verified. Sponsor reserves the right to withhold delivery of a First Prize package if the winner does not comply with any and all of the above requirements. Prizes pictured in promotional materials are for illustrative purposes only. Actual prize may vary from the prize pictured and pictures are used for purposes of prize description only and the use is not intended to suggest or imply participation, sponsorship, endorsement or approval of the Sweepstakes. All trademarks used herein are the property of their respective owners.

Grand Prize Details: The potential Grand Prize winner will be notified by email by March 10, 2016. Potential Grand Prize winner (parent/legal guardian if a winner is an eligible minor in his/her place of residence) will be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release (where lawful) and W9 tax form, which must be received by Administrator within five (5) business days of the date notice or attempted notice is sent, in order to claim the prize. If a potential Grand Prize winner cannot be contacted, or fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release and W9 tax form or provide any other requested information within the required time period, the potential Grand Prize winner forfeits their prize without compensation of any kind. In the event that the potential Grand Prize winner is disqualified for any reason, Administrator will award the prize to an alternate winner in a random drawing from among all remaining eligible entries provided sufficient time exists prior to the event date. If trip destination (i.e., Louisville, Kentucky) is located less than 200 miles from winner’s residence (as determined by Sponsor/Administrator in their sole discretion), Sponsor, in its sole discretion, reserves the right to provide winner with $500 in spending cash for driving expenses in lieu of air travel. Grand Prize winner cannot assign or transfer prize, in whole or in part, and no cash redemption, in whole or in part, is allowed except by Sponsor in its sole discretion. Meals, gratuities, hotel incidentals, phone calls, additional ground transportation, luggage fees, souvenirs, personal services, insurance (of any kind), and all other expenses not specified herein as being included in the prize are the winner’s sole responsibility. The winner and his/her guest must travel together on the same itinerary and must depart from and return to the same (U.S.) airport. Sponsor reserves the right to structure the travel route in its sole discretion. Travel arrangements must be made directly with Sponsor/Administrator. Winner and guest will not receive any award points, frequent flier miles or other “perks” in conjunction with prize travel. Travel arrangements must be made directly with Sponsor and must be booked at least 30 days prior to departure. Flight schedules are subject to change without notice. The Sponsor and Administrator are not liable for any expenses incurred as a consequence of flight cancellation/delay. The winner is solely responsible for securing all necessary travel documents, including identification. Prize winner and/or guest may be required to provide a credit card at the time of hotel check-in to cover, among other things, incidentals and other expenses incurred that are not included as part of the prize. In the event the Grand Prize winner or his/her guest miss any flight or shuttle transportation as provided, the flight/shuttle transportation is non-refundable and the Sponsor and Administrator are not obligated to provide alternate travel or accommodations. The Sponsor and Administrator are not liable for any expenses incurred as a consequence of flight cancellation/delay. Horse race event tickets are subject to the terms and conditions specified on the ticket. Ticket type is of Sponsor’s sole choosing; for the avoidance of doubt, ticket only includes admission to horse race event. No responsibility is assumed for any cancellation or rescheduling of the horse race event, in whole or in part. If any of the foregoing events or activities are delayed, postponed or cancelled for any reason, the travel portions of the Grand Prize shall constitute full satisfaction of Sponsor’s prize obligation to winner and no substitute or additional compensation will be awarded. The guest of the winner (unless the guest is a child/legal ward of the winner) must be eighteen (18) years of age or older as of the date of departure. If winner is a minor in his/her state of residence, travel companion must be winner’s parent/legal guardian. The guest of the winner (parent/legal guardian if a guest is an eligible minor in his/her place of residence) must execute liability/publicity releases (where lawful) prior to issuance of travel documents. Winner and guest must act in a well-behaved and appropriate manner at all times, following all instructions of Sponsor and its designees (i.e., prize suppliers, as applicable). Should Sponsor determine that Grand Prize winner and/or guest fail to comply with this requirement, trip may be terminated for winner and/or guest and Sponsor shall have no further liability or obligation to winner and/or guest (as applicable). If Grand Prize winner chooses to travel without a guest, the Grand Prize will only be awarded in increments appropriate for one (1) traveler (including only one (1) ticket to horse race event) and no compensation or substitute prize will be awarded in conjunction therewith. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.

If Sponsor so elects, the potential Grand Prize winner may be required to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Sweepstakes will not bring Sponsor into public disrepute, contempt, scandal or ridicule, or reflect unfavorably on the Sweepstakes as determined by Sponsor in its sole discretion; and, potential Grand Prize winner agrees to cooperate fully with Sponsor and its agencies relative to the performance of such background check by providing all necessary consents and materials in conjunction therewith and to be bound by its results. The Grand Prize winner will be issued an IRS form 1099, a copy of which will be furnished to the IRS, for the value of the prize in January 2017. All income taxes on the prize are the winner’s sole responsibility. By accepting the prize, the winner agrees that any liability concerning or arising out of his/her prize rests solely with the air carrier, car rental agency or ground transportation on which the winner traveled and the hotels that provided lodging. Furthermore, winner, by accepting any prize (be it the Grand Prize or a First Prize), acknowledges that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality, mechanical condition or fitness for a particular purpose. (And, for First Prizes, the only warranties are those of the manufacturer of the mixer/blender.)

Release: By accepting a prize, the winner agrees to release, discharge, defend, indemnify and hold the Sponsor, Administrator and the Released Parties and each of their parent companies, respective officers, directors, employees, representatives and agents, harmless from and against any claims, damages, losses or liability due to any injuries, (including death), property damage, personal injury (including without limitation emotional distress), publicity rights, defamation or invasion of privacy arising from or in connection with participation in the Sweepstakes to any person or property of any kind resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse or use of the prize or participation in any prize related activities (including without limitation travel related thereto) including any and all costs and attorneys’ fees incurred in responding to and/or defending such claims.

Publicity: By accepting a prize, winners unless otherwise prohibited by law, grants the Sponsor and the Released Parties, the right, without limitation or further permission or further compensation, to use and publish the winner’s name and any travel companion’s names, photographs, voices, and/or likeness, statements, biographical information and city and state of residence for promotional, advertising, publicity and marketing purposes in any manner in commerce and in any medium now known or hereafter devised throughout the world in perpetuity without limitation and without further notice or approval. The winners’ names may also be posted, at Sponsor’s sole discretion, on the winner page of the Sweepstakes website and/or on other websites following verification of the winners, and may be announced by news release.

General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void in AK and HI and where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software (including filtering by or other operation of the functionality of mobile phone carriers); (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged, corrupted, misdirected, inaccessible or incomplete email transmissions/uploads/entries; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason a person’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible (as determined by Sponsor/Administrator, in their sole discretion); if not possible, Sponsor and Administrator shall have no liability of any kind. If the Sweepstakes, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for the prizes offered herein or to make the prizes available to be won in another manner of Sponsor’s sole choosing which is fair, appropriate and consistent with these Official Rules (as determined by Sponsor in its sole discretion). And, notice of such action by Sponsor shall be posted on the Sweepstakes website.

Disputes: Entrants agree that (1) any and all disputes, claims, and causes of action arising out of, or connected with, this Sweepstakes (including without limitation, any alleged violation of these Official Rules, any controversy relating to the arbitrability of any dispute, or any claim that these Official Rules (or any part thereof) is invalid, illegal, or otherwise voidable (or void) shall be resolved individually, without resort to any form of class action, and exclusively by arbitration to be held solely in the state of California under the auspices of the American Arbitration Association and pursuant to its Commercial Dispute Resolution Rules and Procedures; (2) any and all claims, judgments, liabilities, and/or awards shall be limited to actual out-of-pocket costs incurred, including costs associated with Entrant’s participation in this Sweepstakes or otherwise accessing this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives, all rights to claim, punitive, special, incidental, and/or consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. IN AGREEING TO RESOLVE ANY DISPUTE VIA ARBITRATION, ENTRANT UNDERSTANDS AND AGREES THAT HE/SHE IS WAIVING HIS/HER RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO A GIVEN ENTRANT. Judgment upon the arbitration award may be entered in any court having jurisdiction thereof. This arbitration provision shall be deemed to be self-executing, and in the event that either party fails to appear at any properly noticed arbitration proceeding, an award may be entered against such party notwithstanding said failure to appear. In no event shall Entrant seek or be entitled to rescission, injunctive, or other equitable relief or to enjoin or restrain the operation of this Sweepstakes, exploitation of any advertising or other materials issued in connection therewith, or exploitation of this Sweepstakes or any content or other material used or displayed on this Sweepstakes. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
