Terms & Conditions

1) Organizer & Eligibility

i) This ”Prego Mother’s Day Contest” [”the Contest”] is organized by Campbell Soup Southeast Asia Sdn Bhd [”the Organizer”] and is open to all Malaysian residents above 15 years of age as of 1^st January 2016.

ii) The following group of persons shall not be eligible to participate in this Contest:

(a) Employees of the Organizer [including its affiliated and related companies] and their immediate family members [children, parents, brothers and sisters, including spouses]; and/or

(b) Representatives, employees, servants and/or agents of advertising and/or promotion service providers of the Organizer [including its affiliated and related companies], and their immediate family members [children, parents, brothers and sisters, including spouses].

2) Duration:

i) The contest period will run from 21/04/2016 at ”7.00pm” to 09/05/2016 at ”2.00pm” (both dates inclusive) [’Contest Period’].

ii) The Organizer reserves the right to revise the Contest Period at any time without prior intimation. All entries received outside the Contest Period will be disqualified.

3) Submission of Entries & Qualifying Criteria

i) Participants must be registered as a member of the www.facebook.com website. Registration is via www.facebook.com/PregoMalaysia or the Prego Malaysia Facebook Fan Page [”Website”]. Please refer to the Terms & Conditions on the Website, which will bind the members and users of the Website.

ii) To participate in this Contest, members of the Website must first ”Like” the Prego Malaysia Facebook page (fb.com/PregoMalaysia) and access the application ”Prego Mother’s Day” [”the Application”].

iii) To participate in the contest, participants are required to submit a photo of their family representing a ”Family Moment”.

iv) Photo submission must be clear and resolution should be sufficient for printing. Following photos will be disqualified:

(1) Poor quality of Photo (including low resolution and/or cropped photo that do not fill the background)

(2) Photos that do not represent a ”Family Moment”

(3) Photos that do not feature the participant’s family

(4) Duplicate photo submission

4) How to Participate:

i) Like the Prego Malaysia Facebook Fan page.

ii) Access the Application by clicking on the ”Prego Mother’s Day” tab.

iii) Upload your photo

iv) Register your details:

(1) Your Mother’s name

(2) Valid Malaysian Address to post the card

(3) Postcode

(4) City

(5) State

(6) Valid Email address

(7) Read & Approve the Terms & Conditions

v) You can submit only one photo per family member.

5) There are two tiers prizes to this Contest:

a) ”Share & Print”

1. Photograph Prizes

– There will be a total of 1,000 photos printed

2. Allocation of free photographs

i. The ”Share & Print” photos that meet the requirements and that do not violate the Terms & Conditions of this contest, will be printed at the end each period and posted within the following week to the address given during the submission period.

ii. Printed photos will be sent on first come first serve basis, up to a maximum of 1,000 photos.

b) ”Love & Shop” RM100 Giant Shopping Vouchers x 60 winners

1. Prize periods

– Period 1 from Thursday 21^st April at 7:00pm (inclusive) to Thursday 28^th April 2016 at 2:00pm (exclusive)

o There will be a total of 20 units of Giant Shopping vouchers worth RM100 each (expiry date by 30^th June 2016)

– Period 2 from Thursday 28^th April at 2:00pm (inclusive) to Wednesday 4^th May 2016 at 11:59pm (inclusive)

o There will be a total of 20 units of Giant Shopping vouchers worth RM100 each (expiry date by 30^th June 2016)

– Period 3 from Thursday 5^th May to Monday 9^th May 2016 at 2:00pm (inclusive)

o There will be a total of 20 units of Giant Shopping vouchers worth RM100 each (expiry date by 30^th June 2016)

2. Distribution of voucher prizes

20 entrants will be drawn from the eligible entries submitted in each prize period and shortlisted.

6) Shortlisting

i) All shortlisted entries will be reviewed by a panel chosen by the Organizer

ii) Participants are strictly allowed to submit only one entry per family. Family refers to siblings, father and mother.

iii) All entries that are in violation of the Terms & Conditions of this will be invalid and will be disqualified.

iv) A participant that fulfills all the photo requirements and completed all required personal details will be eligible to win a RM100 shopping voucher.

v) All shortlisted participants will be notified by email or mail provided in the registration page.

vi) The shortlisted participant will be required to answer a simple question about a Prego Product or Recipe via email. A shortlisted participant will win 1 x RM100 shopping voucher upon answering the question correctly to the Promoter’s satisfaction.

vii) If a shortlisted participant does not answer correctly, then another will be randomly drawn from the pool of eligible entrants for the relevant prize period and contacted with the Prego question until all 20 of the RM100 shopping vouchers for that prize period are won.

viii) Participants may win only one shopping voucher prize throughout the Contest Period.

ix) Photos submitted are not carried forward from one prize period to another.

x) The count of entries will be tracked using the email and mailing as the unique identification code of each participant.

xi) Decisions by the judges are final relating to all aspects of the selection and disqualification process and results. Judges may disqualify any entry if participant or related parties violate any of the Terms & Conditions attached to the Contest.

7) Prize Redemption

i) All prizes will be posted by normal mail or courier services at the discretion of the Organizer.

ii) The Organizer will not entertain any requests for extension of time to collect the prizes.

iii) The Organizer will not be held liable in the event of non-receipt or delayed delivery of the email notification to the winner(s).

iv) The Organizer will not be held liable in the event of non-receipt of the photos and/or the prizes to the winner(s).

v) List of winners will be published on the Website or any other mediums deemed fit by The Organizer.

vi) In the event of non-receipt by the winner of the email notification, notification as published on the Website page or any other mediums deemed fit by the Organizer shall be deemed sufficient notice and the winner cannot use the reason of non-receipt of email notification to extend the prize collection deadlines, after which the prizes will be forfeited.

vii) All prizes are given on an ”As Is” basis and are not exchangeable for cash, credit, other items or voucher in part or in full.

viii) The risk in the prize(s) shall pass to the winner(s) upon collection. It is the responsibility of the winner(s) to obtain, at their own cost and expense, the relevant & requisite warranties associated with the product prize(s) directly from the respective manufacturers/suppliers.

ix) The Organizer shall reserve the right at its absolute discretion to substitute any of the prizes with alternative prizes of similar value, at any time without prior notice. The actual prizes may differ from the visuals shown on the contest page.

x) As a condition of accepting the prize, winners may be required to sign any legal documentation as and in the form required by the Organizer and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

8) Technical Requirements

i) All photos to be submitted/loaded must comply with the following specifications:

(a) Max file size: 2Mb;

(b) Format: .JPG, .PNG;

ii) Submissions that do not adhere to these requirements will be automatically disqualified. No email notification of disqualified entries will be sent out to the participants.

iii) The Organizer shall not be held liable or responsible for any delay and/or failure in the receipt of entry due to the inability of the respective Internet Service Provider [ISP] company and/or telecommunication network to provide timely and/or efficient internet and/or telecommunication services.

9) Prohibited Content:

i) Below is a partial list of content that is illegal or prohibited to be posted on the Organizer’s Website and/or Facebook App. Posting of any of this content by the participant may, in the Organizer’s sole discretion, result the disqualification of participation, and the removal of the photo from the photo gallery. In addition, the Organizer reserves the right to investigate and take appropriate legal action, in its sole discretion, against anyone who violates this provision, including without limitation, removing the offending communication from the Organizer’s Website and/or Facebook App and reporting such violators to the appropriate legal authorities.

(i) Deemed indecent or not in line with the concept and spirit of this contest

(ii) Offensive to the online community, such as content that promotes racism, politically religious agendas, inflammatory religious content, violence, foul language, bigotry, hatred or physical harm of any kind against any group or individual;

(iii) Harasses or advocates harassment of another person;

(iv) Involves the transmission of ”junk mail”, ”chain letters,” ”spam,” or any other unsolicited mass mailing, e-mailing, or other communication;

(v) Includes any information that the participant knows is false or misleading, promotes illegal activities or conduct that is abusive, or is threatening, obscene, defamatory, or libelous;

(vi) Constitutes or includes any illegal or unauthorized copy of another person’s copyrighted or copyrightable work, including, but not limited to, pirated computer programs or links to them, information which circumvents manufacturer-installed copy-protect devices, pirated music or links to pirated music files;

(vii) Includes material that exploits people in a sexual or violent manner;

(viii) Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses.

(ix) Photos and/or videos that are nasty/ offensive, endanger people/ public property or dangerous in any sense.

(xii) In breach of any intellectual property, privacy

(xiii) Defamatory

(xiv) Obscene

(xv) Derogatory

(xvi) Pornographic

(xvii) Sexually inappropriate

(xxii) Objectionable with respect to race, religion, origin or gender

(xxiii) Not suitable for children aged under 15, or otherwise unsuitable for publication.

10) Liability & Responsibility

i) Every photo submitted must be the participants’ original work and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity.

ii) If the entry contains elements which are subject to the rights of third parties, the participant is responsible for obtaining prior to submission all releases and consents necessary to permit use as outlined herein. ”The Organizer” reserves the right to request proof of these permissions.

iii) By submitting an entry, participant warrants and represents that he/she and any persons appearing or who are otherwise identifiable in the entry consents to the submission and the use of the entry.

iv) Winners shall assume full liability and responsibility in case of any liability, mishap, injury, loss, damage, claim or accident [including death] resulting from their participation in this Contest, redemption and/or usage of the prizes. The Organizer shall not be responsible for any liability, mishap, loss, damage, claim or accident [including death] in any manner whatsoever.

v) All costs and/or any other costs, fees and/or related expenses that are incurred to participate in this Contest and to redeem the prizes are the sole responsibility of the winner.

vi) The Organizer is also not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of the Website, any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the internet and/or Website.

vii) The Website and Facebook Apps are provided on an ”as is” basis and, except as otherwise prohibited by applicable law, the Organizer expressly disclaim any warranty of any kind, including, but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Organizer cannot guarantee and do not promise any specific results from use of the Website and Facebook Apps. No advice or information, whether oral or written, obtained by you from us, or from or through the Website shall create any warranty not expressly stated herein.

viii) The Organizer will not be held liable for any downloaded play of the Facebook Apps.

11) Rights of the Organizer

i) By submitting an entry on the application, participants will be bound by these Official Terms & Conditions and acknowledge that all rights to the photos are released for general viewing and use by the Organizer, its subsidiaries, and agents.

ii) All entries submitted become the property of the Organizer. Entries will not be returned to any Participant. As a condition of entering into this Contest, each Participant licenses the Organizer to use their Entry in any media for an unlimited period for any reason including but not limited to future promotion, marketing or publicity purposes without any liability for payment of any consideration or otherwise for all times to come.

iii) By submitting an Entry in the Contest, the participant, unless the Organizer advises otherwise, license and grant the Organizer, its affiliates and sub-licensees an exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Entry along with the photo for any purpose in any media, without compensation, restriction on use, attribution or liability.

iv) The Participant agrees not to assert any moral rights in relation to the use of the Entry.

v) Organizer and their promotional agents reserve the right to remove photos it deems indecent or not in line with the concept and spirit of this contest without notice or explanation. It is at the sole discretion of Organizer what it considers inappropriate and unsuited for general public viewing.

vi) The Organizer shall reserve the right to publish, use the names and/or photographs and/or videos of the winners as materials for the purposes of advertising and/or trade publicity, without any prior notice to the winners and the winners shall not be entitled to claim ownership or other forms of compensation on the materials.

vii) The Organizer reserves the right to modify, suspend or cancel this Contest in the event that it becomes not capable of running as planned, technically interfered or corrupted, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Organizer, despite the best efforts of the Organizer.

viii) The Organizer holds the right to change/amend the rules and regulation of this contest without any prior notice to the participants.

ix) The Organizer reserves the right, in its sole discretion, to disqualify any participant that is found or suspected of tampering with the Contest submission process, the operation of this Contest or to be in violation of the Conditions of Access of the Website. The Organizer reserves the right to disqualify any person who it reasonably suspects has violated or infringed any of these general Terms & Conditions and the Organizer reserves the right to pursue legal action against any individual it believes has undertaken fraudulent activities or other activities harmful to this online Contest, the Contest submission process, the Website and/or Facebook Apps.

x) Participants may receive future promotional messages from the Organizer.

12) Other Terms & Conditions

i. Neither the Organizer or Organizer’s representative offices, authorized agencies or any other associated sponsors associated with the Contest shall be held liable for any failure or omission to carry out the Contest in accordance with these T&Cs.

ii. The Organizer collects your personal details in order to conduct the Contest, and may pass that information to its related bodies, corporate and agencies assisting with the Contest. iii. The Contest Terms & Conditions are prepared in English version only.

4. All taxes/levies and charges on prizes will be the responsibility of the winner. Taxes as applicable will be deducted at the source for all prizes or shall be deposited in advance by the winner and produce proof before claiming the prize.

v. All transportation, accommodation, personal costs and/or any other costs and/or related expenses that are incurred to participate in this contest and to redeem the prize are the sole responsibility of the participants and winners.

6. Organizer shall not be liable for any loss or damage due to Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss.
7. All disputes relating to this Contest shall be subject to the exclusive jurisdiction of Courts at Kuala Lumpur only.
