1. PROMOTION PERIOD: The Savor The Flavor Instant Win Game & Sweepstakes (the “Promotion”) consists of an instant win game (the “Instant Win Game”) and a sweepstakes (the “Sweepstakes”). The Promotion begins on 08/24/16 at 12:00:00 a.m. Eastern Time (“ET”) and ends on 09/30/16 at 11:59:59 p.m. ET (the “Promotion Period”). The Administrator’s computer is the official time keeping device for this Promotion.
2. ELIGIBILITY: The Promotion is open only to legal U.S. residents currently residing in any of the fifty (50) United States (including DC), who are at least eighteen (18) years of age or older, at the time of play/entry. Franchisees and employees, directors and officers of Dunkin’ Brands Inc. (“Sponsor”), Mondelēz Global, LLC, bottlerocket marketing group, llc (“Administrator”) and any of their respective affiliates, parents, subsidiary companies, and advertising and promotion agencies (the “Released Parties”), and members of the immediate families (spouses, parents, children, and siblings and their respective spouses, regardless of where they reside), and/or those living in the same household, of any of the foregoing, are not eligible to play/enter or win. The Promotion is subject to all applicable federal, state and local laws. By participating in this Promotion, entrants agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsor, and by the decisions of Sponsor, which are final in all matters relating to the Promotion.
3. HOW TO PLAY/ENTER: For the purposes of this Promotion, a “day” is a calendar day, beginning at 12:00:00 a.m. ET and ending at 11:59:59 p.m. ET. Multiple entrants are not permitted to share the same email address or account. Any attempt by any entrant to obtain more than the stated number of Plays/Entries by using multiple/different email addresses, identities, registrations, accounts, logins, or any other methods will void that entrant’s Plays/Entries and that entrant may be disqualified. Use of any automated, programmed, robotic or similar system to participate is prohibited and may result in disqualification.
   1. Instant Win Game – During the Promotion Period, visit www.DDsavortheflavor.com (the “Promotion Microsite”) and follow the onscreen prompts to advance to the registration page, complete all required registration information, confirm your eligibility and you agreement to the official rules and click the submit button. You will then have the opportunity to click the mouse (if playing via a desktop) or use your finger on the screen (if playing via a mobile device) in order to scratch off the virtual Dunkin’ Donuts Belgian Waffle Breakfast Sandwich image to reveal if you are an instant winner (hereinafter a “Game Play” or “Play”). As you scratch off the virtual Dunkin’ Donuts Belgian Waffle Breakfast Sandwich image, a message will appear indicating whether or not you’re an instant winner. If you are an instant winner, the message will indicate what you’ve won, and may provide directions for prize verification and fulfillment. If you are not a winner, the screen will indicate that you are not an instant winner and you will be asked to try again tomorrow. For the avoidance of doubt, you have not “Played” the game until you scratch off the virtual Dunkin’ Donuts Belgian Waffle Breakfast Sandwich image and reveal a winning or non-winning message. Each participant, regardless of email address used, may Play the Instant Win Game one (1) time, per day, throughout the Promotion Period.
   2. Sweepstakes – During the Promotion Period, each time an entrant successfully Plays the Instant Win Game, regardless of the outcome, that person will receive one (1) sweepstakes entry (“Entry”) into the Sweepstakes grand prize random drawing (the “Grand Prize Drawing”). Entrants can therefore receive thirty-eight (38) Entries into the Grand Prize Drawing simply by Playing the Instant Win Game.
4. INSTANT WIN GAME PRIZE WINNERS AND PRIZES/APPROXIMATE RETAIL VALUE (“ARV”): Six hundred and fifteen (615) random, computer-generated winning times will be generated during the Promotion Period. A computer algorithm will spread the six hundred and fifteen (615) winning times over the thirty-eight (38) day Promotion Period. Odds of winning an Instant Win Game prize depend on the actual number of eligible Instant Win Game plays received and the timing of the game plays. If you are the player to play the Instant Win Game exactly at, or the first player to play immediately after one (1) of the predetermined randomly generated winning times, you will be a potential Instant Win Game prize winner. In these winning moments, a winning message with congratulatory copy detailing verification and/or fulfillment information will appear. These potential winners of the Instant Win Game may be provided directions for validation and verification before any Instant Prize is awarded, or Sponsor may unilaterally verify such potential Instant Prize winners as official, and fulfill the Instant Prize within 4-6 weeks, utilizing the information provided upon registration. In non Instant Prize winning moments, entrants will receive messaging indicating they have received the specified amount of Extra Sweepstakes Entries and will be encouraged to come back every day during the Promotion Period to play the Instant Win Game again. Instant Prizes and/or Extra Sweepstakes Entries are not transferable or redeemable for cash and Sponsor reserves the right, in its sole discretion, to substitute a prize (or a portion thereof) for a prize of greater or equal value. The difference between any approximate retail value (“ARV”) and actual retail value of any Instant Prize (due to market fluctuations at the time of prize award) will not be awarded in cash. Taxes, if any, on a prize, are solely the responsibility of the winner. The Instant Win Game prizes are detailed in the chart below. In the event there are not enough eligible Game Plays with the applicable team selected, in order to award all Instant Prizes for such applicable team, such Instant Prizes will remain un-awarded.

5. SWEEPSTAKES GRAND PRIZE WINNER SELECTION AND GRAND PRIZE/ARV: On or about two (2) days after the Promotion Period has ended, Administrator, an independent judging agency, will conduct the Grand Prize Drawing to select two (2) potential Grand Prize Winners. The Grand Prize Drawing will be conducted from among all eligible Entries received throughout the Promotion Period. The odds of being selected as the potential Grand Prize winners depends on the total number of eligible Entries received throughout the Promotion Period. The Grand Prize winners, once confirmed as detailed below, will each receive one (1) $500 Dunkin’ Donuts mGift (Virtual DD Card). The ARV of each Grand Prize is five hundred dollars ($500). The total ARV of the Grand Prizes is one thousand dollars ($1,000)
6. PRIZE WINNER NOTIFICATION/VERIFICATION: By participating in this Promotion, entrants give their express permission to be contacted by Sponsor or Administrator by email, mail, text message, or by phone. No Grand Prize or Instant Prize winner is an official winner unless all necessary paperwork has been returned (if applicable), as determined by Sponsor, and/or until Sponsor confirms such. There is no limit to the amount of Instant Prizes any one (1) entrant can win throughout the Promotion Period, and an Instant Prize winner is still eligible to win the Grand Prize.

The potential Instant Prize winners may be required to confirm their mailing addresses (physical and/or electronic) in order to claim their prize. If a potential Instant Prize winner cannot be contacted, fails to confirm necessary information, has an email delivery returned as undeliverable, or is found by the Sponsor and/or Administrator after further research and investigation to not be an actual Instant Prize winner said potential Instant Prize winner may be disqualified and will forfeit the Instant Prize. In the event there are not enough Game Plays to award all Instant Prizes, such Instant Prizes will not be awarded. A entrant is not an official Instant Prize winner, even if a winning message should so indicate, unless and until entrant’s eligibility has been confirmed and verification is complete, in Sponsor’s sole discretion. Sponsor will not accept screen shots or other evidence of winning in lieu of its validation process. If for any reason, there are disputes as to the number of actual Instant Prize winners, the validation of potential Instant Prize winners, or more Instant Prizes are claimed than set forth in these rules, in the Sponsor’s and Administrator’s sole discretion, Sponsor and Administrator may override the Instant Win Game computer algorithm and award all Instant Prizes by conducting random drawings from among all eligible Instant Win Game Plays received throughout the Promotion Period.

All Prizes: Sponsor shall use best efforts to award all prizes listed in these Official Rules. In no event will more than the stated number of prizes listed in these Official Rules be awarded. In total, there is a potential for five thousand and twenty-five dollars ($5,025) in prizes to be awarded during the Promotion.

7. GENERAL CONDITIONS: Actual value of Instant Prizes and Grand Prizes will depend on current market conditions at time of prize fulfillment, and any difference between the stated ARV and the actual value of the prize, if any, will not be awarded, except at Sponsor’s sole discretion. If any portion of the Grand prize is unable to take place as planned, or be awarded, for any reason, including but not limited to, cancellation, scheduling conflicts, or an event of force majeure, that portion of the prize will be forfeited, the remaining components of the prize will be awarded and Sponsor’s obligation to the winner will be fulfilled, and no other additional compensation will be provided (if any). By participating in and/or accepting a prize in this Promotion, entrants hereby consent to the use by Sponsor of their information (first name, last initial, city, state), and/or likeness, in any media now known or hereinafter developed throughout the world, without additional consideration (except where prohibited), consent or prior review, and upon request will provide written consent to such use. The prize conditions stated herein are not all-inclusive and may be subject to additional conditions, which may be stated at a later time. Please allow up to 4-6 weeks after the Promotion Period to receive an Instant Prize. Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures, viruses, tampering, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion Microsite, the Sweepstakes, or the Instant Win Game, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the Instant Win Game and Sweepstakes prizes at random from among the eligible Plays/Entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it suspects to be tampering with the Play/Entry process or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all eligible, legitimate, un-awarded, prize claims. If any part of these Official Rules are determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty and liability disclaimers set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and these Official Rules shall continue in effect.
8. INTERNET & GENERAL LIMITATIONS OF LIABILITY: Released Parties are not responsible for interrupted or unavailable network servers, Internet access or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled Instant Win Game Plays or misdirected Sweepstakes Entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, inability to upload or download any information in connection with participating in the Instant Win Game or Sweepstakes, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person’s computer related to participating in the Instant Win Game or Sweepstakes. Released Parties are not responsible for glitches or technical malfunctions in the administration of the Instant Win Game or Sweepstakes. Released Parties are not liable for any Internet connectivity costs, dial-up access costs, or upload fees. Released Parties are not responsible for illegible, unintelligible, lost or late Instant Win Game Plays or Sweepstakes Entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or Instant Win Game promotion or by any technical or human errors which may occur in the processing of any Instant Win Game Plays or Sweepstakes Entries in this Promotion. Persons found tampering with, abusing any aspect of this Promotion, or violating these Official Rules, will be disqualified and may be subject to prosecution. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE INVOLVED IN THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE INSTANT WIN GAME OR SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All prizes are awarded “AS IS” and without warranty of any kind, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. Any and all guarantees and warrantees on merchandise prizes are subject to the manufacturer’s terms and conditions and winners agree to look solely to said manufacturers for any such warranty or guarantee claim. SPONSOR MAKES NO WARRANTIES OTHER THAN THOSE ACCOMPANYING THE PRODUCTS BEING AWARDED AS THE PRIZE. IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THIS PROMOTION OR ACCEPTANCE OR USE/MISUSE OF ANY PRIZE. Each entrant hereby agrees to release, indemnify, and hold harmless the Released Parties from any claims, actions, damages, losses or injury of any kind including but not limited to personal injury or death, resulting from participating in the Promotion or from acceptance, use or misuse of a prize awarded or participation in any prize-related activity. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income, or profit; loss or damage to property; and claims of third parties. Entrants agree that the Released Parties have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express, or implied (including but not limited to the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to the Promotion.
9. GOVERNING LAW: THIS PROMOTION IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE ANY DISPUTE WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO CLASS ACTION.
10. PRIVACY: Any personally identifiable information collected during your participation in this Promotion will be collected by Sponsor and used by it and its agents solely for purposes of the proper administration and fulfillment of the Sweepstakes and Instant Win Game as described in these Official Rules and will not be shared with any third party except as stated in Sponsor’s Privacy Policy, posted at (http://www.dunkindonuts.com/content/dunkindonuts/en/help/privacypolicy.html).
11.
