Big Red’s PANDORA One PROMO Official Terms and Conditions

PLEASE READ CAREFULLY. NO PURCHASE NECESSARY, A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING.  OPEN TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE 18 YEARS OF AGE OR OLDER. VOID WHERE PROHIBITED BY LAW. By participating in Big Red’s PANDORA One PROMO, each entrant unconditionally accepts and agrees to comply with and abide by these Official Terms and Conditions.
Big Red’s PANDORA One PROMO (“Promotion”) is a sweepstakes sponsored by Big Red, Inc. (“Sponsor”) through which individuals can enter for the chance to win a one year subscription to Pandora ONE (http://www.pandora.com/one) (“Prize”) by submitting an entry at www.bigred.com/pandora (“Website”) between 12:00:01 AM Central Time (“CT”) February 1, 2016 and 11:59:59 PM CT March 18, 2016 (“Entry Period”). Winners will be chosen in a random drawing on or around April 1, 2016.  There will be a total of eighty-five (85) Prizes available. Odds of winning will depend on the amount of entries received during the Entry Period.

Eligibility

The Promotion is open to legal residents of the 50 United States and the District of Columbia who are 18 years or older at the time of entry submission. The Promotion is void where prohibited by law.

Employees and non-employee workers of Big Red, Inc., Big Red bottlers, Dr Pepper Snapple Group, Inc., Pandora Media, Inc., their respective parent companies, subsidiaries, affiliates, and agents and agencies involved in Big Red’s PANDORA One PROMO, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such person are not eligible to participate in the Promotion. Former employees of Big Red, Inc. and its Promotion affiliates must provide documentation that it has been at least one (1) calendar year since the final date of employment.  Pandora Media, Inc. and its parent company, subsidiaries and affiliates are not Sponsors of the Promotion and are not responsible for the collection, submission or processing of entries, the administration of the Promotion, or the selection of winners.

Each entrant will receive one (1) entry upon registration in the Promotion as outlined below. Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. By entering and participating in the Promotion, each entrant fully and unconditionally agrees to and accepts these Official Terms and Conditions and the decisions of the Sponsor, which are final and binding in all matters related to the Promotion.

Duration

The entry portion of Big Red’s PANDORA One PROMO commences at 12:00:01 AM CT on February 1, 2016 and ends at 11:59:59 PM CT on March 18, 2016.  Entries submitted past the expiration of the Entry Period will not be accepted.  Sponsor reserves the right to shorten, extend, suspend, modify, or cancel the Sweepstakes, at its discretion, at any time.

How to Enter

Visit www.bigred.com/pandora during the Entry Period and follow the online instructions to submit your name, email address, age, city, and state of residence. Website entries must be received by March 18, 2016 11:59:59 PM CT.

Limited to one (1) entry per person each day during the Entry Period. Entries must be submitted solely by the entrant. The email address used to enter must be subscribed and registered in entrant’s name. The authorized email account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization, which is responsible for assigning email addresses or the domain associated with the submitted email address. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The email address submitted must be valid throughout the Promotion. All entries become the property of Sponsor. Sponsor is not responsible for unforeseen technical difficulties that may arise throughout the course of entry to the Promotion.

Selection of Winners

The winners will be determined by random drawing on or around April 1, 2016 from all eligible entries received. Drawings will be held at the discretion of Big Red, Inc. The odds of winning depend on the number of eligible entries received during the Entry Period. The potential winners will be notified by the email address provided upon entry, within fifteen (15) days of the drawing. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify potential winners. By accepting a Prize, winners consent to the use of their names, voices, and likenesses for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law, and, upon request, will provide such consent in writing. If a selected winner cannot be contacted, is ineligible, or fails to claim the Prize within fifteen (15) days from the time award notification was sent, the Prize may be forfeited and an alternate winner will be randomly selected. Sponsor will verify accuracy of entries before a winner is announced publicly. The receipt by any winner of a Prize offered in this Promotion is conditioned upon compliance with any and all federal and state laws and regulations.

ANY VIOLATION OF THESE OFFICIAL TERMS AND CONDITIONS BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Prizes

There will be a total of eighty-five (85) Prizes available, each consisting of a code (each a “Pandora One Pass”) redeemable for a single one (1) year subscription to Pandora ONE, (approximate retail value: $60). Sponsor reserves the right to forfeit or award any unclaimed or leftover Prizes at its sole discretion. The Prize winners shall be solely responsible for all federal, state and local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the Prize.

Pandora One Passes are redeemable only at www.pandora.com/gifts. Pandora One Passes do not expire prior to activation. One time use only; code is void after activation. Subscription passes to Pandora One are subject to the Pandora One Terms applicable to Pandora One Subscriptions and available at http://www.pandora.com/legal/one. Use of code constitutes acceptance of all applicable terms and conditions. Pandora codes and passes are issued by Pandora Media California, LLC.

General Terms and Conditions

To learn how the personal information collected in connection with the Promotion may be used, participants should read Sponsor’s Privacy Policy, which is available at http://bigred.com/Privacy. The terms of Sponsor’s Privacy Policy are incorporated herein by reference.

The Sponsor reserves the right to discontinue the participation privileges of any entrant who engages in any fraudulent activity or uses the Promotion in a manner inconsistent with these Official Terms and Conditions or with any federal, state or local, laws, statutes or ordinances. In addition, Sponsor shall have the right to take appropriate administrative and legal action, including criminal prosecution, as it deems necessary in its sole discretion.
The Promotion is open to individuals only. Corporations, associations or other groups may not participate in the Promotion.
Sponsor is not responsible for any incorrect or inaccurate information supplied by any entrant participating in the Promotion.

All questions or disputes regarding eligibility for the Promotion or an entrant’s compliance with these Official Terms and Conditions will be resolved by the Sponsor in its sole discretion.

Limitation of Liability

The Released Parties (as defined below) are not responsible for incorrect or inaccurate transcription of information, for problems related to any of the equipment or programming associated with the Sweepstakes or utilized by the entrant, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network, cellular network, or electronic transmission, for problems relating to computer equipment, software, inability to access the Website or online service, or for any other technical or non-technical error or malfunction. By participating, entrants agree to release, indemnify, and hold harmless Big Red, Inc., Big Red Bottlers, Dr Pepper Snapple Group, Inc., Pandora Media, Inc., and their respective related companies, parents, subsidiaries, affiliates, and respective agents and their agencies, suppliers and other companies involved in the development or execution of the Promotion or the production or distribution of Promotion materials (“Released Parties”) from any and all liability, injury, loss, or damage of any kind arising from or in connection with participation in this Promotion or use of a Prize.

Entrant agrees that the ReleaseD PARTIES shall not be responsible or liable for, and are hereby released from, any and all costs, losses, damages, or other liability of any kind, due in whole or in part, directly or indirectly, to participation in the Promotion or from Entrant’s acceptance or use or misuse of any Prize.
INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Terms and Conditions, or the rights and obligations of entrant and the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Texas, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Texas.
