Unlimited Cellular Official Sweepstakes Rules

1. ELIGIBILITY: The UNLIMITED CELLULAR Sweepstakes (the “Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. No purchase is necessary to enter or win, and a purchase will not increase your chances of winning. Employees of Unlimited Cellular, Inc., and its affiliates, as well as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Sweepstakes is subject to federal, state, and local laws.
2. SPONSOR: The Sweepstakes is sponsored by Unlimited Cellular, Inc., located at 251 Walsh Avenue, Suite 100, New Windsor, New York 12553.
3. AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Sweepstakes Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon compliance with these Official Rules and fulfilling all other requirements set forth herein.
4. HOW TO ENTER: All entrants are required to “Like” UNLIMITED CELLULAR’s Facebook page (or pages) upon entering the Sweepstakes and at the time of each drawing. In addition, all entrants are required to post on their Facebook page a profile picture showing a likeness of themselves that is not negative, defamatory, obscene or inappropriate, in the opinion of the Sponsor. If the Sponsor, in its sole discretion, believes that the picture posted is not a true likeness of the entrant or that it is negative, defamatory, obscene or inappropriate, the Sponsor reserves the right to reject such Entry.

Entrants enter the Sweepstakes by filling out and submitting the Entry Form found on UNLIMITED CELLULAR’s Facebook page, and at http://www.unlimitedcellular.com/Sweepstakes-Sign-Up_ep_45-1.html. Limit of one (1) entry per person or email address. Entries received from any person or email address in excess of the stated limitation will be void. All entries become the property of the sponsor and will not be acknowledged or returned.

In entering the Sweepstakes, you agree to receive promotional emails and other materials from UNLIMITED CELLULAR and its affiliates. You may opt to discontinue these emails and promotional materials at any time.

5. PRIZE: Prior to each drawing, the Sponsor shall determine, at its sole discretion, the prize to be offered in the Sweepstakes. Once the prize has been accepted by a Sweepstakes winner, it cannot be returned for any reason.
6. PRIZE DRAWING AND SWEEPSTAKES PERIOD: On or about the first of December, 2015, one winner will be selected at random for the weekly prize, from all eligible entrants who submitted entries from the inception of UNLIMITED CELLULAR’s iPhone 6s Sweepstakes to 11:59 p.m. on 11/27/2015. The odds of winning depend on the number of eligible entries received.

The winner must be a duly accepted entrant in the year in which the prize is drawn. An entrant is eligible to win every time there is a drawing. Thus, if there is a drawing each week for the next fifty-two (52) weeks, the entrant will have fifty-two chances to win. However, each entrant is eligible to win a Sweepstakes prize only once within any sixty (60) day period.

7. WINNER NOTIFICATION: The winner will be notified by email within five (5) days of the prize drawing. The winner must reply to this notification within seven (7) days and provide a shipping address. The prize will be shipped to the winner within one (1) week of Sponsor’s receipt of the winner’s shipping address. If the winner is at least 18 but still considered a minor in his/her jurisdiction or residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to fulfill all requirements imposed on the winner herein. If the winner cannot be contacted, or fails to send Sponsor his/her shipping address, the Sponsor may select an alternate winner in his/her place at random from the non-winning, eligible entries.
8. TRANSFER: Prizes are not transferrable. Only the person designated on the Entry Form may claim the prize. In the event of a dispute as to the identity of a person submitting an Entry Form, then the Entry Form will be deemed to be submitted by the person in whose name the email account appearing on the Entry Form is registered.
9. RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, its affiliates, advertising and promotion agencies, other companies associated with the Sweepstakes (including, but not limited to, Facebook), and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, or undeliverable mail or email; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, by entrant’s participation in the Sweepstakes or receipt or use of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the value of the prize awarded, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
10. TAXES: Winners will be responsible for all applicable Federal, State and local taxes.
11. GENERAL CONDITIONS: The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited by law. In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Sweepstake Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any term of these Official Sweepstakes Rules shall not constitute a waiver of that provision. Sponsor reserves the right to modify or cancel this promotion at any time and, in the event of cancellation, substitute another in its place.
12. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Southern District of New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Sweepstakes Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
13. WINNER LIST: To request the names winners, send a self-addressed stamped envelope to Unlimited Cellular, Inc., PO Box 1071, Newburgh, NY 12550. Winner List requests will only be accepted within four (4) weeks of the prize drawing. Winner list requests may also be submitted by email to Sponsor’s Facebook page: https://www.facebook.com/unlimitedcellularstore
